No. 3490 establishing Underground District lo. 5; and WHEREAS, Section 31.08.030 of City Code requires that property )wners be notified of the time to be ready to connect to the Under- \round system by subsequent Resolution; and WHEREAS, the underground system is to be completed by April 1975, and overhead poles are to be removed by May 15, 1975; and NGW, THEREFORE, BE IT RESOLVED by the City Council of the City )f Carlsbad as follows: 1. That the date on which affected property owners must be -eady to receive underground service is April 1, 1975. 2. That a certified copy of this Resolution be recorded in :he County Recorder's office and also mailed to each affected pro- Ierty owner. FRAZEE, M&or .. ,i 0 0 SECOND AMENDXENT TO AGREEMENT BETWEEN CITY OF CARLSBAD AND COUNTY OF SAN DIEGO RE: TRAFFIC SIGNAL EL CAYIN0 REAL AT LA COSTA AVENUE THIS AMENDMENT to agreement executed this day of 3 1975, by and between CITY OF CARLSBAD, a municipal corporation, hereinafter called rrCityr' and the COUNTY OF SAN DIEGO, a political subdivision of the State of California, hereinafter called "County". RECITALS 1. The City and County have entered into an agreement for the installation and maintenance of a Traffic Signal on El Camino Real at La Costa Avenue, hereinafter called "the Projectrr, lying within the juris- diction ofthe City and the County. to as "Agreement" was executed on December 11, 1973, (#74) and is filed with Said agreement, hereinafter referred the Clerk of the Board of Supervisors as County Contract No. 5050 - 7812 and with the City Clerk as Resolution No. 3268. 2. The City and County desire to modify the terms of the Agreement to provide for the County to perform the maintenance of the traffic signals and lighting system installed as a part ofthe project. , \ NOW, THEREFORE, IT IS AGREED by and between the parties as follows: Amend Sections 7 through 11 to read: . .. County shall bill City quarterly for the costs and charges for the 11. preceding quarter due to County, pursuant to paragraphs 8, 9, and 10 above. Bills for extraordinary maintenance, including both replacement and repair, shall show an itemization of the costs of labor, parts and equipment used and/or expended in each particular instance. Payment shall be made by City to County within thirty (30) days after receipt of said bills. All other terms and conditions of the original agreement remain unchanged.
