HomeMy WebLinkAbout1975-03-04; City Council; Resolution 3603i 20 21 22 23 24 25 26 27 20 29 I- o RESOLUTION NO. 3603 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING FINDINGS AND DECISION REGARDING CHANGE OF ZONE (ZC-150) FROM RD-M TO R-1-7500 ON A 1.5-ACRE PARCEL LOCATED ON THE EAST SIDE OF LAGOON LANE BETWEEN POINSETTIA LANE AND THE BATIQUITOS LAGOON. t APPLICANT: RANCHO LA COSTA PARTNERSHIP WHEREAS, on January 28, 1975, a duly advertised public hearing was held before the Planning Commission in the manner pre- scribed by law to consider a change of zone from RD-M to R-1-7500 on property described as follows: Beginning at the center of Section 28 thence Northerly along the quarter Section line, North OO28'17" East 133.00 feet; thence South 89°07'00" West, 282.00 feet: thence South 71°42'00" East, 444.33 feet to the Northerly line of North half, Southeast quarter Section 28, thence along said Northerly line, North 89°07'00" West, 705 feet to the point of beginning, all to allow a 307-lot subdivision over 92.8 acres on property located on the east side of Lagoon Lane between Poinsettia Lane and Batiquitos Lagoon, as shown on map marked ZC-150, Exhibit A, dated December 27, 1974; and WHEREAS, at the conclusion of said hearing the Planning Commission of the City of Carlsbad adopted Resolution No. 1131 recommending said zone change which is herewith referred to and made a part hereof: and WHEREAS, on February 18, 1975, the City Council held a public hearing on the matter, received all recommendations and heard all persons interested in or opposed to the proposed change 1 4 5: z 2( 2: 2: 2: 24 2; 2( 2' 21 2! t 0 of zone; and WHEREAS, an Environmental Impact Report was certified as complete for a previously issued entitlement for this project, and the Planning Director has found the zone change to be in prior compliance'with the City of Carlsbad Environmental Protec- tion Ordinance of 1972; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the findings of the Planning Commission con- tained in the aforementioned Resolution No. 1131 constitute the findings of the Carlsbad City Council. 3. That the approval of the proposed change of zone classification is necessary to carry out the general purpose of Title 21 of the Municipal Code. 4. That the City Council of the City of Carlsbad intends to adopt an ordinance to effectuate the proposed change of zone. PASSED, APPROVED AND ADOPTED at a meeting of the City Council on the 4th day of March , 1975, by the following vote, to wit: AYES: Councilmen Frazee, Chase, Lewis and Skotnicki and NOES: None ABSENT:None Counci 1 woman Cas1 er 2.
