HomeMy WebLinkAbout1975-03-18; City Council; Resolution 36093 2c 21 22 23 24 25 26 27 28 29 A RES0 UT RESOLUTION N0.3609 ON OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING WITH CONDITIONS TENTATIVE MAP (CT 74-23) TO ALLOW AN 8-LOT SUBDIVISION ON 2.36 ACRES LOCATED ON THE WEST SIDE OF MONROE STREET BETWEEN PARK DRIVE AND MAGNOLIA AVENUE. APPLICANT: MICHAEL STRAUB WHEREAS, on January 28, 1975, the Carlsbad City Planning Commission adopted Resolution No. 1133 recommending to the City Council that Tentative Map (CT 74-23) be conditionally approved; and WHEREAS, the City Council of the City of Carlsbad, on March 4, 1975 considered the recommendation of the Planning Commission; and WHEREAS, said Tentative Map has been declared to have a nonsignificant impact on the environment and a Negative Declara- tion has been prepared and filed in compliance with the require- ments of the City of Carlsbad Environmental Protection Ordinance of 1972; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That Tentative Map (CT 74-23) is hereby approved sub- ject to all applicable requirements of the Carlsbad Municipal Code and to the satisfaction of the following conditions: 1. The final map shall be submitted for approval within one year from the final action by the City Council on the Tentative Subdivision Map. The final map shall be in substantial conformance to the Tentative Subdivision Map known as Exhibit B, dated January 22, 1975, on file in the Planning Department. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations and restrictions of all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force for the purpose of preserving the residential characteristics of adjacent properties. 3. All public improvements shall be made in conform- ity with the City of Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision Ordinance and other City standards to the satisfaction of the City Engineer without cost to the City of Carlsbad and free of all liens and encumbrances. Improvement plans for water and sewer systems shall meet the requirements of the respective service districts. 4. All land and/or easements required by this ordi- nance shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances. No easements shall be recorded prior to approval of the final map unless approved by the City Engineer. 5. All utilities, including provisions for cable TV, shall be placed underground and/or shall be completely concealed from view. 6. In order to provide for reasonable fire protection during the construction period, the subdivider shall main- tain passable vehicular access to all buildings, and ade- quate fire hydrants with required fire flows.and dry- stand pipes shall be installed prior to framing construc- tion. 7. Park-in-Lieu Fees shall be granted to the City concurrent with City Council approval of the final map. 8. Street trees, when required by the City, shall be installed by the applicant at hisyexpense. Trees shall be of a type approved by the Parks Department and shall be installed to their specifications. If removal of any existing trees is required by the City, said removal shall be at the applicant's expense. It shall be the responsibility of the applicant to make all arrangements with the Parks Department concerning the requirements of this condition. These arrangements are to be made prior to approval of the final map. 9. An additional 9-foot right-of-way along the sub- division boundary adjoining Park Drive shall be dedicated concurrent with City Council approval of the final map. The developer shall construct complete half- street improvements for Monroe Street and Park Drive prior to the issuance of building permits. dedicated, except along the southeasterly 50 feet adjoin- ing the Park Drive right-of-way. 11. Lot 1 access rights to Monroe and Park shall be 12. The City will not accept the proposed 40-foot- wide drainage and sewer easement at the southerly boundary of Lots 1, 3 and 5 for public maintenance. That said Tentative Map, together with the provisions for its design and improvement and subject to the above conditions is consistent with all applicable general and specific plans of the City of Carlsbad. EXHIBIT A e AMENDPENT TO CONTRACT BETWEEN THE BOARD OF A?3MINISTRATION PUBLIC EPLPLOYEES' RETIREMENT SYSTEM AND THE CITY COUNCIL OF THE CITY OF CARLSBAD The Board of Administration, Public Employees' Retirement System, hereinafter referred to as Board and the CITY COUNCIL of the CITY OF CARLSBAD, hereinafter referred to as Public Agency, having entered into a contract under date of December 23, 1955, effective January 1, 1956, as amended effective July 1, 1957, January 1, 1959, March 5, 1959 and March 4, 1975, and as provided by Chapters 170 and 316, Statutes of 1971, which provide for participation of Public Agency in said System, Board and PUblic Agency hereby agree as follows: The following said paragraph shall be added to paragraph 5 of said contract: "Local policemen shall include persons who are employed to perform identification and communication duties in the Police Department who are not now local. safety members and who were in such employment on August 4, 1972 and who elect safety membership within 60 days of the effective dat of this amendment," This amendment shall be attached to said contract and shali become effective on the eighteenth day of March, 1975.
