HomeMy WebLinkAbout1975-03-19; City Council; Resolution 36171 2 3 4 5 6 7 8 9 10 11 12 13 n 14 2c 21 22 22 24 25 26 27 28 k u Clh RESOLUTION NO. 3617 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE ISSUANCE OF A CERTIFICATE TO THE MESA TAXI COMPANY TO OPERATE FOUR TAXICABS IN THE CITY OF CARLSBAD AND ORDERING THE CITY CLERK TO ISSUE SAID CERTIFICATE SUBJECT TO CERTAIN CONDITIONS. WHEREAS, the Mesa Taxi Company in accord with Chapter 5.20 of the Municipal Code has applied for a Certificate of Conven- ience and Necessity to operate taxicab service within the City of Carlsbad; and WHEREAS, pursuant to said chapter a public hearing was held before the City Council of the City of Carlsbad on March 4, 1975, to determine whether or not the public interest, convenience and necessity require the issuance of the certificate applied for; and WHEREAS, at said hearing all persons having interests in the matter were heard: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the public interest, convenience and necessity require the issuance of the certificate applied for. 3. That said certificate is hereby issued to Robert H. Hall, doing business as Mesa Taxi Company, subject to the follow- ing terms and conditions: 1 2 3 4 5 6 7 a 9 1c 11 12 13 0 2c 21 22 22 24 2E 2E 27 2E nr (a) The certificate permits service throughout the City of Carlsbad. (b) Four taxicab vehicles are authorized. (c) The schedule of fares to be charged shall be: Initial drop $.60 including first 1/6 mile; $.lo for each additional 1/6 mile; waiting time $6.00 per hour; meter and one-half for all long distance runs; parcel delivery charge of $1.00 or meter. (d) The certificate and the operation of taxi ser- vice pursuant thereto shall be subject to all of the pro- visions of Chapter 5.20 of the Municipal Code. (e) The certificate is issued for an initial period of one year, said period to commence on the date of adop- tion of this resolution. The City Council may grant two one-year extensions by minute action without holding additional public hearings. (f) Applicant's application form dated January 8, 1975, shall be a part of the certificate with the addendum attached thereto on file in the office of the City Clerk and incorporated by reference herein. (4) The City shall have the right to inspect all vehicles at any time to insure they are maintained in safe operating condition. (h) Applicant may only use the vehicles listed on his application dated January 8, 1975. (i) Applicant shall file certificates of insurance in the amounts of $100,000/300,000 with the City Clerk prior to commencing service pursuant to this certificate. (1) No taxi stands are permitted. 4. That the City Clerk is hereby directed to issue a copy of this resolution as a certificate in accord with Chapter 5.20 of the Carlsbad Municipal Code. 5.
