HomeMy WebLinkAbout1975-03-19; City Council; Resolution 3619., 1 2 3 4 5 6 7 8 9 10 11 12 13 D 14 2c 21 2% 22 24 25 26 27 28 t 0 nn RESOLUTION NO. 3619 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AN AGREEMENT BETWEEN THE CITY OF CARLSBAD AND THE COUNTY OF SAN DIEGO FOR THE REMOVAL OF ABANDONED VEHICLES WITHIN THE CITY, AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT. WHEREAS, the City Council of the City of Carlsbad has enacted an ordinance pursuant to 5 22660 of the California Vehicle Code establishing an Abandoned Vehicle Abatement Program which provides for the removal of abandoned vehicles from private property within the City of Carlsbad; and WHEREAS, the County of San Diego has established an en- forcement mechanism for administration of the above program and has offered to contract with the City of Carlsbad for enforce- ment within the limits of the City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That that certain agreement between the City of Carls- bad and the County of San Diego for the removal of abandoned vehicles within the City, a copy of which is attached hereto as Exhibit A and incorporated herein by reference, is hereby approved, 3. That the Mayor of the City of Carlsbad is hereby authorized and directed to execute said agreement for and on behalf of the City of Carlsbad. adjourned PASSED, APPROVED AND ADOPTED atan/regular meeting of the Carlsbad City Council held on the 19th day of March , 1975, by the following vote, to wit: AYES: Councilmen Frazee, Chase, Lewis, Skotnicki and NOES: None Councilwoman Casler ATTEST : (SEAL) 2. Adam City Clerk City of Carlsbad 1200 Elm Avenue Carlsbad, California 92008 Dear Mrs. Adams: You are correct in that Oceanside Yellow Cab Company does not propose an additional $1.05 per mile charge on mileage driven 5 miles or more outside the City limits. MEMORANDUM TO : City Clerk FROM: City Attorney DATE: April 18, 1975 RE : Oceanside Yellow Cab Company The City Manager has asked that I look into a minor confusion which apparently exists regarding the rates which the Council recently approved as part of a Certificate of Convenience and Necessity issued to the Oceanside Yellow Cab Company. I have reviewed Resolution No. 3618 which approved a permit andthe Oceanside Yellow Cab Company's application which contained the information for the resolution. It appears that in preparing the resolution the word "additional" was inadvertently added to the $1.05 per mile charge on mileage driven five miles more outside the City limits. By letter dated April 16, 1975, Oceanside Yellow Cab Company confirms that the charge for such mileage is $1.05 per mile and not an additional $1.05 per mile over and above the regular mileage rates. In my view the matter can be corrected by simply striking the word "additional" in the appropriate place in Resolu- tion No. 3618. You may want to consider notifying the Oceanside Yellow Cab Company and any other interested parties that the correction- has been made. VINCENT F. BIONDO, JR. VFB : af cc: City Manager
