HomeMy WebLinkAbout1975-04-15; City Council; Resolution 36351 2 3 4 5 6 7 a 9 10 11 12 13 14 -(3 20 21 22 23 24 25 26 27 28 29 z - u A E RESOLUTION NO. 3635 UTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING RESOLUTION NO. 3345 BY THE AMENDMENT OF EXHIBITS A, C AND D THERETO TO REVISE THE ENVIRONMENTAL IMPACT ASSESSMENT FORM, THE GUIDELINES FOR THE PREPARATION OF A PRE- LIMINARY ENVIRONMENTAL REPORT AND THE CONTENTS OF AN ENVIRONMENTAL IMPACT REPORT AS REQUIRED BY THE AMENDED GUIDE- LINES ISSUED BY THE SECRETARY FOR RESOURCES PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT OF 1970. WHEREAS, pursuant to the California Environmental Quality Act of 1970, as amended, the Secretary for Resources of the State of California has issued amended guidelines effective February 18, 1975 which revise some of the procedures for the implementation of said Act; and WHEREAS, said amended guidelines obligate the City to amend its procedures in accord with said amendments; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That Resolution No. 3345 is amended by of Exhibits A, C and D thereto as follows: (a) Exhibit A to Resolution No. 3345 the amendment s hereby amend- ed in accord with the document titled Revisions to Exhibit A to Resolution No. 3345 dated April 15, 1975, which is attached hereto and incorporated by reference herein. (b) Exhibit C to Resolution No. 3345 is hereby amend- ed in accord with the document titled Revisions to Exhibit C to 3 4 5 6 7 8 10 11 11 and incorporated by reference herein. (c) Exhibit D to Resolution No. 3345 is hereby amended by the document marked Revisions to Exhibit D to Resolu- tion No. 3345 dated April 15, 1975, which is attached hereto and incorporated by reference herein. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the15th day of April , 1975, by the following vote, to wit: AYES: Councilmen Frazee, Chase, Lewis and Skotnicki NOES: None 13 ii ABSENT: Counci lwoman Cas1 er .r ATTEST : J (SEAL) 21 22 23 2. 29 II April 15, 1975 REVISIONS TO EXHIBIT A TO RESOLUTION NO. 3345 Exhibit A to Resolution No. 3345, "Preliminary Environmental Impact Form", is amended as follows: 1. Paragraph I, "Background Information", is amended by the addition of paragraph 3 to read: "3. Describe energy conservation measures incorpor- ated into the design and operation of the project. This discussion should include energy efficient building design and construction practice and use of resource conserving forms of energy. 'I April 15, 1975 REVISIONS TO EXHIBIT C TO RESOLUTION NO. 3345 Exhibit C to Resolution No. 3345, "Preliminary Environmental Impact Form",is amended as follows: 1. Paragraph C, "Mitigation Measures Proposed to Minimize the Impact", is amended to read: "Discuss and describe all avoidable adverse impacts including inefficient and unnecessary consumption of energy and the measures proposed to minimize these impacts. Include an identification of the acceptable levels to which such impacts will be reduced and the basis upon which such levels were identified. Where alternative measures are available to mitigate an impact, each should be discussed and a basis for selecting one alternative should be identified. Energy conservation measures as well as other appropriate mitigat- ing measures shall be discussed. Include a discussion of alternative strategies, features or design that could mini- mize the adverse environmental impact. For example, erosion problems might be eliminated or reduced by doing grading only during the drier months. Or, alternatively, plans could be made to plant and establish solid growths of the proper vegetation to retard erosion. Environmental degradation should always be balanced against beneficial factors of the project. Examples of energy conservation measures may be found in Appendix F to the State EIR Guidelines." 2. Paragraph I, "Organization and Persons Consulted", is amended to add: "List all other public agencies having jurisdiction by law over the project." 3. Paragraph J, "General Plan Considerations", is added to read: "Describe all general plan provisions applicable to the subject property. Such discussion shall include an individual consideration of each of the elements of the general plan and shall indicate in detail how each of those elements applies to the subject property. A similar dis- cussion shall also be included for any applicable specific plans since most discretionary developmental approvals must now be fully consistent with all applicable general and specific plans. A discussion should also be included of the relationship of the proposed project to such consistency requirements. April 15, 1975 REVISLOTS TO EXHIBIT D TO RESOLUTION NO. 3345 Exhibit D to Resolution No. 3345 contents of Environmental Impact Reports is amended as follows: 1. Paragraph 4, "Environmental Impact" is amended to add: "If they are not discussed separately, the EIR shall include a table showing where each of the subjects is discussed. 'I 2. Paragraph 4 (b) is amended by striking the words, "do not neglect", in the last sentence of the paragraph, replacing them with the word, "describe". 3. Paragraph 4(c), "Mitigation Measures Proposed to Minimize the Impact", is amended to read: "Describe avoid- able adverse impacts, including inefficient and unnecessary consumption of energy and the measures proposed to minimize these impacts. This discussion shall include an identifi- cation of the acceptable levels to which such impacts will be reduced and the basis upon which such levels were identi- fied. Where alternative measures are available to mitigate an impact, each should be discussed and a basis for select- ing one alternative should be identified. Energy conserva- tion measures, as well as other appropriate mitigation measures, shall be discussed. Examples of energy conserva- tion measures include but are not limited to the following: (1) Insulation and other protection from heat loss or heat gain to conserve fuel used in heating buildings. (2) Use of resource-conserving forms of energy such as solar energy for water and space heating, wind for operating pumps, and falling water for generating electricity. (3) Energy efficient building design, including such features as orientation of structures to summer and winter sunlight to absorb winter solar heat and reflect or avoid summer solar heat. (4) Measures to reduce energy consumption in transportation such as providing access to bus lines, mass transit, bicycle lanes, pedestrian facilities and use of small cars instead of large ones. (5) Efficient lighting practices, including use of indirect natural light, use of efficient light- ing fixtures, establishment of reasonable lighting criteria to prevent over-illumination, and minimum use of architectural or display lighting. (6) Energy-conserving construction practices. (7) Use of energy conservation devices such as flywheels. (8) Rate structures which discourage unnecessary energy consumption. (9) is feasible. Paragraph 4(d) is amended by striking the words, "attention should be paid to", in the last sentence of the paragraph replacing them with the word, "describe". 5. Paragraph 4 (e) is amended by striking the words, ''special attention should be given to", in the second sen- tence of the paragraph replacing them with the word, "de- scribe". 6. Paragraph 6, "Water Quality Aspects", is amended "Describe in the environmental setting section and to read: other sections where applicable water quality aspects of the proposed project which had been previously certified by the appropriate state or interstate organization as being in substantial compliance with applicable water quality standards. I' 7. Paragraph 7, "Contents of Final Environmental Impact Report", is amended by the amendment of subsection (a) to read: "(a) The final EIR shall consist of: (1) The draft EIR. (2) Comments and recommendations received (3) A list of persons, organizations and on the Draft EIR. public agencies commenting on the Draft EIR. (4) The responses of the City to signifi- cant environmental points raised in the review and consulta- tion process. I' 2.
