RESOLUTION NO. 3637
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA APPROVING AN AGREEMENT BETWEEN THE CITY OF CARLSBAD AND THE CITY OF OCEANSIDE FOR THE SECOND
SUPPLEMENT TO AGREEMENT FOR TEMPORARY CONNECTION BY THE CITY OF OCEANSIDE TO THE JOINT SEWER SYSTEM AND AUTHORIZING
THE MAYOR TO EXECUTE SAID AGREEMENT
The City Council of the City of Carlsbad, California, does
hereby resolve as follows:
1. That that certain agreement between the City of Carlsbad
and the City of Oceanside for the second supplement to agreement
for temporary connection by the City of Oceanside to the Joint
Sewer System, a copy of which is attached hereto marked Exhibit
A and incorporated herein by reference, is hereby approved.
2. That the Mayor of the City of Carlsbad is hereby authorizc
and directed to execute said agreement for and on behalf of the
City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council of the City of Carlsbad, California, held on the
6th day of May , 1975, by the following vote, to wit:
AYES: Councilmen Frazee, Chase, Lewis, Skotnicki and Councilwoman Casler
NOES: None
ABSENT: None

THIS AGREEMENT is made and entered into as of the 6th day
of May , 1975, by and among the CITY OF OCEANSIDE,
( "Oceanside")
and
VISTA SANITATION DISTRICT ("Vista") , the CITY OF CARLSBAD
("Carlsbad") , BUENA SANITATION DISTRICT ("Buena") , SAN ?L?IRCOS
COUNTY WATER DISTRICT ("San Marcos") , LEUCADIA COUNTY WATER
DISTRICT ("Leucadia") and ENCINITAS SANITARY DISTRICT ("Encinitas'
who are hereinafter sometimes referred to collectively as
"Owners".
RECITAL
Oceanside and the Owners have heretofore entered into an
AGREEMENT FOR TEMPORARY CONNECTION BY CITY OF OCEANSIDE dated
July 5th, 1972 and FIRST SUPPLEMENT TO AGREEMENT FOR TEMPORARY
CONNECTION BY CITY OF OCEANSIDE dated July 16th, 1974, and wish
to amend said Agreement and First Supplement in the manner
hereinafter set forth.
NOW, THEREFOPE, IT IS AGREED BETWEEN OCEANSIDE AND THE
OWNERS AS FOLLOWS:
Section 2 of the AGREEMENT FOR TEMPORARY CONNECTION BY CITY
OF OCEANSIDE dated July 5th, 1972, as amended by FIRST SUPPLEMENT
TO AGREEMENT FOR TEMPORARY CONNECTION BY CITY OF OCEANSIDE dated
July 16th, 1974, is hereby further amended to read as follows:
"Section 2. Term of Agreement. This Agreement and
the permission given to Oceanside for the temporary
