HomeMy WebLinkAbout1975-07-17; City Council; Resolution 36971f 9 2c 21 22 22 24 25 26 27 28 30 i- is WSOLUTION NO. 3697 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AN ASSIGNMENT AGREEMENT BETWEEN THE CITY OF CARLSBAD AND MEDICAL FINANCE COMPANY OF SAN DIEGO FOR COLLECTION OF DELINQUENT ACCOUNTS FOR CITY-PROVIDED EMERGENCY MEDICAL TRANSPORTATION, AND AUTHORIZING THE CITY MANAGER TO EXECUTE SAID AGREEMENT. The City Council of the City of Carlsbad, California, does hereby resolve as follows: 1. That that certain agreement between the City of Carlsbad and Medical Finance Company of San Diego for collection of certain delinquent accounts for City-provided emergency medical transportation, a copy of which is attached hereto as Exhibit A and incorporated herein by reference, is hereby approved. 2. That the City Manager of the City of Carlsbad is hereb: authorized and directed to execute said agreement for and on behalf of the City of Carlsbad. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 17t h day of July , 1975, by the following vote, to wit: AYES : Councilmen Frazee, Lewis, Skotnicki and NOES : Councilman Chase Councilwoman Casler ABSENT: None ATTEST : y OF SAN DIEGO-A COLLECTlON AGENCY 1012 SOUTH HILL STREET .* OCEANSIDE, CALEF. 92854 * PHONE: 722-1953 Accounts submitted for collectiun, receipt of which will be acknowledged in writing, are assigned tu Doddco Corporation, doing business as MEDICAL FINANCE COlilPANY of Sari Diego, a Collection Agency, for collection on the following commission basis: The city will receive 75% of all money collected on the account, except that 0x1 all accounts where payments of $25 or less are accepted the city will receive 50% of all money collected instead of the above mentioned 75%. It is also understood that the city will receive 50% of all money collected on any account that has moved out of California instead of the above mentioned 75%. It is agreed that any or all of the above accounts may be withdrawn by the city after ninety (90) days, except those on which payment is being made. The city authorizes the said LKEDICAL FIKAWCB CONPARTY to use any legitimate method necessary to collect the above accounts and to make such compromise settlements as may seem advisable, so long as said settlement will not return to the city less than 50% of the balance due on the account. It is further agreed that no cour-t action will be filed on any of the assigned accounts without specific prior approval of the city. By Paul D.
