HomeMy WebLinkAbout1975-07-17; City Council; Resolution 37001 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 22 24 25 26 27 2e -- e RESOLUTION NO. 3700 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADOPTING THE SALARY PLAN FOR THE MISCELLANEOUS EMPLOYEES AND POLICE AND FIRE SAFETY EMPLOYEES FOR FISCAL YEAR 1975-1976 AND RESCINDING RESOLUTIONS 3686 AND 3693. WHEREAS, the City Council by Resolution 3686 adopted an interim salary plan for fiscal year 1975-1976 to allow negotia- tions between management and employee groups to continue beyond July 1, 1975; and WHEREAS, the City Council by Resolutions 3691 and 3692 approved Memorandums of Understanding regarding wages and other terms and conditions of employment for Fire Safety and Police Safety personnel for fiscal year 1975-1976, and by Resolution 3693 implemented a portion of said recommendations by the adoption of the salary plan for said employees for said year, superseding a portion of the interim salary plan; and WHEREAS, a Memorandum of Understanding has been reached between management representatives and the Carlsbad City Employees Association, which has been approved by City Council Resolution No. 3699 : and WHEREAS, it is now appropriate to implement that portion of said Memorandum providing for salary adjustments for Miscellane- ous Employees by the adoption of an amended salary plan; and WHEREAS, it is desirable to consolidate all salary adjust- ments in one salary plan and rescind the interim salary plan and the separate Fire and Police Safety salary plan; . . 1 2 3 4 5 6 7 8 9 IC 11 12 1: 0 14 2( t 0 21 2: 2: 2L 2! 2( 2'; 2t NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the Revised Classification and Salary Range Schedule, as set out in Exhibit A attached hereto and made a part hereof, is hereby adopted as the salary plan of the City of Carlsbad for all Miscellaneous, Police and Fire Safety personnel included therein for fiscal year 1975-1976; those portions of said plan applicable to Fire and Police Safety personnel to be effective July 1, 1975 and those portions applicable to Miscel- laneous personnel to be effective July 8 , 1975. 3. That Resolution 3686 adopting an interim salary plan is rescinded 4. That Resolution 3693 adopting an amended salary plan for Police and Fire Safety personnel is rescinded. WHEREAS, the City of Carlsbad City Miscellaneous Employees Association has been negotiating as part of the meet and confer process with representatives from Management regarding wages and certain other terms and conditions of employment to be effective for fiscal year 1975-1976; and WHEREAS, the parties to said negotiation have reached agree- ment and wish to present this Memorandum of Understanding incorporating all terms of that agreement to the City Council and request that it be approved and implemented; NOW, THEREFORE, IT IS AGREED by and between the Management representatives (City) and the Carlsbad City Miscellaneous Employees Association (Association) that the following terms and conditions of employment for fiscal year 1975-1976 be submitted to the City Council: 1. 2, 3. Employee Suggestion Award Program. Maternity Leave. City and Association agree that at such time as the exlsting Personnel System Rules and Regulations are redrafted they will provide the following. a. That a pregnant employee may continue to work until such time as the employee's physician declares that continued work would endanger the health or safety of the employee. b. That a pregnant employee may use all and any accrued sick leave and vacation for purposes related to the termination of pregnancy. .., -; c. That an employee who has terminated a pregnancy may return to work at any time after the termination 5, of the pregnancy that the employeers physician declares the return to work will not endanger the health and or safety of the employee, City Council Policy Number 3. City and Association agree that contents, essence and conditions addressed in City Council Policy Number 3, regarding City-paid tuition assistance for employees, be incorporated in Personnel System Rules and Regulations at such time as those rules are redrafted. 6, Service Requirement for Salary Step B. City and Associa- tion agree that movement from Salary Step A to Salary -2- Step B shall coincide with the change of employee status from probationary to permanent, to apply to all employees hired on or after July 1, 1975. 7. City and Association agree that those employees working a 10-hour day, four day week work schedule shall work two designated Fridays of each succeeding January to compensate for those work weeks during which holidays shortened the work week to 30 hours and for which the employees were paid for a total of 32 hours. 8. Continuance of Terms. All other terms and conditions of employment applicable to included personnel and not inconsistent with the terms of this Memorandum of Under- standing shall remain in effect.
