RESOLUTION NO. 3739
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING
FINDINGS AND DECISION ON A PREANNEXATION
CHANGE OF ZONE (ZC-158) FROM C-1 AND RD-M
to C-1-Q AND RD-M-Q ON PROPERTY LOCATED AT
THE NORTHEAST CORNER OF ALGA ROAD AND EL
CAMINO REAL. APPLICANT: CITY INITIATED
(CAL PACIFIC PROPERTIES, INC.)
S, on July 23, 1975, a duly advertised public hearing
was held before the Planning Commission in the manner prescribed
by law to consider a preannexation change of zone from C-1 and
RD-M to C-1-Q and RD-M-Q on property located at the northeast
corner of Alga Road and El Camino Real, more particularly
described as:
West one-half on the Northeast on-fourth of section
T. 12 S. R. 4 W. Located at the northeasterly inter-
section of El Camino Real and Alga Road and further
described in the files of the Planning Department.
WHEREAS, at the conclusion of said hearing the Planning
:ommission of the City of Carlsbad adopted Resolution 1175
recommending said zone change which is herewith referred to and
nade a part hereof; and
WHEREAS, on August 19, 1975, the City Council held a public
iearing on the matter, received all recommendations and heard all
iersons interested in or opposed to the proposed change of zone;

WHEREAS, an Environmental Impact Report EIR-283 was certifiec
ts complete for a previously issued entitlement for this project,
md the Planning Director has found Zone Change (ZC-158) to be
.n prior compliance with the City of Carlsbad Environmental

3rotection Ordinance of 1972; and
NOW, THEREFORE, BIT IT RESOLVED by the City Council of the
zity of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the findings of the Planning Commission contained
in the aforementioned Resolution No. 1175 constitute the findings
of the Carlsbad City Council.
3. That the approval of the proposed preannexation change
of zone classification is necssary to carry out the general
purpose of Title 21 of the Municipal Code.
4. That the City Council of the City of Carlsbad intends
to adopt an ordinance to effectuate the proposed preannexation
change of zone.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 2nd day of September , 1975
by the following vote, to wit:

NOES: Councilman Chase.
ABSENT: None.
