HomeMy WebLinkAbout1975-09-16; City Council; Resolution 37461 2 c 4 F f r 1 E 5 1C 11 12 1: 14 If 1t 17 1E 19 2c 21 22 25 24 25 26 27 28 29 30 31 32 RESOLUTION NO. 3746 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD MAKING APPLICATION FOR THE DETACHMENT OF TERRITORY FROM THE SAN MARCOS FIRE PROTECTION DISTRICT AND SEEKING APPROVAL QF THE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SAN DIEGO - "CARRILLO RANCH DETACHMENT". The City Council of the City of Carlsbad does hereby resolve as follows: WHEREAS, the City Council of the City of Carlsbad desires to initiate proceedings for the detachment of the territory hereinafter described from the San Marcos Fire Protection District. NOW, THEREFOREy BE IT RESOLVED by the City Council of the City of Carlsbac as follows: Application and a proposal is hereby made to the Local Agency Formation Commission of the County of San Diego for a change of organization as follows: A. B. C. 0. E. This proposal is made pursuant to the District Reorganization Act of 1965, commencing with Section 56000 of the Government Code of the State of California. The nature of the proposed change of organization and the names of all districts for which any such changes of organization is proposed are as follows: 1) The detachment of the hereinafter described territory from the San Marcos Fire Protection District. The names of all affected counties, cities and districts are: 1) 2) 3) The City of Carlsbad. The territory proposed to be detached from San Marcos Fire Protection District is uninhabited. A description of the exterior boundaries of said territory is attached hereto as Exhibit "A" and made a part hereof. It is desired that the proposed detachment provide for and be be subject to the following terms and conditions: The County of San Diego The San Marcos Fire Protection District; and : * 4 I r t 5 I( 11 1; 1: 14 15 1E 17 1F 11 2( 21 22 2: 24 2E 26 27 28 29 30 31 32 1) The City of Carlsbad will pay costs of detachment pro- ceedings, including, but not limited to, LAFCO processing fees and State Board of Equalization fees. F. The reasons for this proposal are as follows: 1) The territory was previously annexed to the City of Car 1 s bad. G. The proposed detachment will have no effect on the environment because it simply eliminates duplication of services to the area. proposal will have a non-significant" impact on the environment and has complied with the requirements of the City of Carlsbad "Environmental Protection Ordinance of 1972". The City, acting as lead agency, has declared that this BE IT FURTHER RESOLVED that the City Council of the City of Carlsbad does hereby request that the Local Agency Formation Commission approve and authorizi the Board of Directors of the San Marcos Fire Protection District to detach such territory. PASSED, APPROVED AND ADOPTED at a meeting of the City Council of the City of Carlsbad held on the 16th day of September , 1975, by the following vote, to wit: AYES: Councilmen Chase, Lewis, Skotnicki and Councilwoman NOES: None ABSENT: Counci 1 man Frazee ABSTAIN: None Cas 1 er ATTEST: (SEAL) -2-
