RESOLUTION NO. 3781
Clerk of the City of Carlsbad and are incorporated herein
by reference;
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the specifications as presented are hereby
approved,
3. That the Purchasing Agent of the City of Carlsbad
is hereby authorized and directed to proceed to publish in I

WHEREAS, the City Council of the City of Carlsba.d,
for the Recorder System hereinabove described, in accordance
with the specifications hereinabove referred to.

:ity of Carlsbad at a regular meeting held November 18, 1975,
~y the following vote, to wit:

JOINT USE AGREEMENT
WHEREAS, Carlsbad Tract No. 75-4 (La Costa Estates North)
has been approved by the City of Carlsbad, Carlsbad Municipal
Water District, Leucadia County Water District and San Diego
County Flood Control District;
WHEREAS, it is the intent of the above-named City and
Districts to share in the use of those certain private streets,
dedicated to the City of Carlsbad as General Utility and Access
Easements of the Tract Map of said Carlsbad Tract No. 75-4 in the
manner shown on the Improvement Plans for said Tract; said Improve-
ment Plans being designated City of Carlsbad Project No. 75-20.
NOW, THEREFORE, the City of Carlsbad, the Carlsbad Municipal
Water District, the Leucadia County Water District and the San Diego
County Flood Control District do hereby agree to occupy those portions
of said General Utility and Access Easements as their facilities
require under the following conditions:
1. That the City and each District shall exercise care to
avoid disturbance of existing facilities of each during installation,
relocation or repair and maintenance of their respective improvements.
2. That the City and each District shall at its own expense
restore the surface to previous condition subsequent to installation,
relocation or repair of its facilities.
3. That the City and each District shall be responsible to
reimburse the other parties hereto for damages caused by the
installation, relocation, use or repair to their respective utilities.

It is hereon understood that each of the parties to the agree-
ment shall have joint use of the surface of said strip for ingress
and egress to their respective portions as hereinabove described.
