HomeMy WebLinkAbout1975-11-18; City Council; Resolution 37864 6 7 8 9 11 12 0 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO, 3786 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING WITH CONDITIONS TENTATIVE MAP (CT 75-8) FOR A ONE-LOT, 22 UNIT CONDOMINIUM PRO- JECT ON PROPERTY LOCATED AT THE SOUTH- WEST CORNER OF PINE AVENUE AND WASHINGTON STREET ADJACENT TO THE AT&SF RAILROAD RIGHT-OF-WAY. APPLICANT: REGAN CONSTRUCTION. WHEREAS, on October 15, 1975, The Carlsbad City P,anning Commission adopted Resolution No. 1197 recommending to the City Council that Tentative Map (CT 75-8) be conditionally approved; and WHEREAS, the City Council of the City of Carlsbad, on November 4, 1975, considered the recommendation of the Planning Commission; and WHEREAS, said Tentative Map has been declared to have a nonsignificant impact on the environment and a Negative Declaration has been prepared and filed in compliance with the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That said Tentative Map, together with the provisions for its design and improvement and subject to the conditions of this resolution, is consistent with all applicable general and specific plans of the City of Carlsbad. C. That the findings of the Planning Commission, in Resolution No. 1197, constitute the findings of the City Council in this matter. 2 3 4 5 6 7 8 9 10 I1 12 n a 19 20 21 22 23 24 25 26 27 28 C. That Tentative Map (CT 75-8) is hereby approved subject to all applicable requirements of the Carlsbad Municipal Code and to the satisfaction of the following conditions: 1. The approval is granted for the land described in the application and any attachments thereto, and as shown on the plot plan submitted labeled Exhibit A, dated August 25, 1975 on file in the Planning Department and incorporated by reference herein. The location of all buildings, fences, signs, roadway, parking areas, landscaping and other facilities or features shall be located substantially as shown on Exhibit A, except or unless indicated otherwise herein. All buildings and structures shall be of the design as shown on the elevation plans labeled Exhibit A. 2. The Final Map shall be submitted for approval within 18 months from the final action by the City Council on the tentative subdivision map, The Final Map shall be in substantial conformance with the Tentative Subdivision Map. 3. In order to provide for reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants with required fire flows shall be installed as recommended by the Fire Department, 4. Ornamental street lighting shall be provided for as required by Municipal Ordinance. The developer shall deposit cash in the amount necessary to energize said street lights for an eighteen month period after con- struction, to permit the incorporation of the subdivision into a maintenance district. 5. All land and/or easements required shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances. No easements shall be recorded prior to recordation of the final map unless approved by the City Engineer, 6. Half street frontage improvements shall be installed in Pine Avenue, based on a 30 foot half street section. The sidewalk shall be installed as to minimize the removal of existing trees, as approved by the City Engineer. 7. Washington Avenue shall be dedicatd and improved on the basis of a 30 foot half street width along the property frontage. Dedication shall include a 20 foot radius property line return at the intersection of Washington Avenue and Pine Street. Improvements shall include a complete cross gutter across Pine Street, 2, +- 1 4 6 7 8 9 10 11 12 2 19 20 21 22 23 24 25 26 27 28 designed to conform with future improvement of Pine Street and Washington Avenue. 8. Park-in-lieu fees shall be granted to the City prior to City Council approval of the Final Map. 9. The CC&R's for this development shall be submitted to the Planning Director for review and approval prior to the approval of the Final Map. 10.No signs or advertising of any type whatsoever shall be erected or installed until plans therefore have been approved by the City of Carlsbad. 11.Prior to the issuance of any building permits, a study of the noise levels on the project site shall be made by an acoustical engineer experienced in noise attenuation. Said study shall determine if attenuation measures are necessary to bring noise levels within 65 db(A) outdoors and 45 db(A) indoors. Said study shall recommend such attenuation measures as deemed necessary, and shall be consistent with applicable provisions contained in the Noise Element of the General Plan and consistent with appropriate sections of the Uniform Building Code.
