RESOLUTION NO. 3801
A RESOLUTIOPa OF THE CITY COUNCIL OF
THE CITY OF CARLSBAD, CALIFORNIA,
AUTHORIZING A REVISION TO ITS LOCAL
TRAXSPORTATION FUND CLAIM TO PROVIDE
AN ADVANCE OF FUMDS TO THE NEWLY
CREATED NORTII SAN DIEGO COWTY
TRANSIT DEVELOPMENT BOARD
WHEREAS, Chapter 1188 of the 1975 California Statutes
has created the North San Diego County Transit Development Board
with an effective date of January 1, 1976; and
WHEREAS, said legislation does not provide funding for
the Board to defray initial administrative and legal expenses of
commencing operation and during the period necessary for the
negotiation of acquisition of the Oceanside Transportation System,
which is currently the Operator of the North County Transit
System; and
WHEREAS, this Council believes said funds in the amount of
$100,000 should be provided out of the Local Transportation Fund
accounts of the affected North County cities of Carlsbad, Escondid
Oceanside, San Marcos, and Vista, and the County of San Diego, wit
each entity's contribution being allocated based upon population.
NOW, THEItEFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, as follows:
1. That the above recitations are true and correct.
2. That the North San Diego County Transit Development
Board should be advanced the sum of $100,000 as soon as possible
after January 1, 1976, from the LTF accounts of the North County
cities of Carlsbad, Escond.ido, Oceanside, San Marcos, and Vista
and the County of San Diego.
3. That the amount advanced from each entity should be
the same percentage of the total amount ($100,000) as each
entity's population bears to the total population of the area to
be served by the said Board as follows:

4. That that certain multi-party contract between the
City of Carlsbad and the other participating jtxisdications to
make funds available to the North San Diego County TEansit Develop
ment Board, a copy of which is attached hereto as Exhibit A, and
made a part hereof, is hereby approved.
5. That the Mayor of the City of Carlsbad is hereby
authorized and directed to execute said contract for and on
behalf of the City of Carlsbad.
I 6. That this Council hereby urges the other affected
entities in North San Diego County to immediately so authorize
their fair shares to be advanced to said Board.

MULTI-PAI<TY CONTRACT
WIZIIWAS, Chapter 1.188 of the 1975 California Statutes has created the
North San Diego County Transit Development Board eifective January 1, 1976;
and
WHEREAS, said legislation does not provide funding for the Board to
defray initial administrative and legal expenses associated with an indc-
terminate period necessary to negotiate the acquisition of the Oceanside
Transportation System; and
WHEREAS, the affected North County cities and communities believe
$100,000 should be provided from the Local Transportation Fund with each
entity’s contribution being based on population;
~ THEREFORE, the cities of Escondido, Vista, Carlsbad, Oceanside and
San Marcos, and the County of San Diego, do hereby agree as follorrs:
1. Based on the following estimates-of individual jurj sdictional popu-
lation, the parties agree to allocate the following amounts of money from the
Local Transportation Fund:

2. The North San Diego County Transit Development Board agrees and is
hereby authorized by all parties to this agreeincnt to clnini the above funds
of $100,000. Sajd funds to be utilized for the purpose‘of implcmcnting the
North San Diego County Transit Devclopnient Board consistent with provisions
of Chapter 3188 of the .California Statutes creating said Board. Thjs claim
is needed due to changing fiiiancial circunistanccs as a result of the new in-
