HomeMy WebLinkAbout1976-02-17; City Council; Resolution 38521 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 le 19 2c 21 22 2: 24 2: 2E 27 2E 2s 3( 31 3: CITY COUNCIL RESOLUTION NO. 3852 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING FINDINGS AND DECISION (EXCLUSIVE AGRICULTURE) ON 339.81 ACRES LOCATED NORTH OF PALOMAR AIRPORT ROAD AND EAST OF PASEO DEL NORTE (LOWDER LANE) APPLICANT: CITY OF CARLSBAD ON A CHANGE OF ZONE (ZC-172) FROM R-A-10,000 TO E-A CASE NO. ZC-172 ~ WHEREAS, on January 28, 1976, a duly noticed public hearing was held before the Planning Commission in the manner prescribed by law to consider a change of zone from R-A-10,000 to E-A on property located north of Palomar Airport Road and east of Paseo del Norte, more particularly described as: A portion of Lot F, G and H of the Rancho Agua Hedionda, in the County of San Diego, State of California, according to Map thereof No. 823 on file in the Office of the County Recorder of said County lying northerly of Road Survey No. 1534 (Palomas Airport Road) on file in the Office of the County Engineer of said County. WHEREAS, at the conclusion of said hearing the Planning Commission of the City of Carlsbad adopted Resolution No. 1217 recommending said Zone Change which is herewith referred to and made a part hereof; and WHEREAS, on February 17, 1976, the City Council held a public hearing on the matter, received all recommendations and heard all persons interested in or opposed to the proposed Change of Zone; and WHEREAS, the matter has complied with the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972 and a negative declaration has been filed by the Planning Department; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That the findings of the Planning Commission contained in the aforementioned Resolution No. 1217 constitute the findings of the Carlsbad City Council. C) That the approval of the proposed Change of Zone is necessary to carry out the general purpose of Title 21 of the Municipal Code. D) That the City Council of the City of Carlsbad intends to adopt an ordinance to effectuate the proposed change of zone.
