HomeMy WebLinkAbout1976-03-09; City Council; Resolution 3860-A1 2 3 4 5 6 7 8 9 10 11 12 13 D 14 20 21 22 23 24 25 26 27 28 I- 0 - on RESOLUTION NO. 3860-A A =SOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING CITY COUNCIL RESOLUTION NO. 3771, TO REVISE THE CONDITIONS OF APPROVAL FOR TENTATIVE MA.€' (CT 75-6) A SUBDIVISION GENERALLY LOCATED ON THE NORTH AND SOUTH SIDES OF ALFIL WAY BETWEEN ALTISHA WAY AND SAN MARCOS CANYON. APPLICANT: LA COSTA LAND CO. (ALICANTE HILLS). WHEREAS, the City Council of the City of Carlsbad on October 21, 1975 adopted Resolution No. 3771 approving with conditions Tentative Map (CT 75-6); and WHEREAS, on January 28, 1976, the Carlsbad City Planning Commission adopted Resolution No. 1215, recommending to the City Council that the conditions of approval for Tentative Map (CT 75-6) be revised to add two lots for open space and park sites and to eliminate an open space easement; and WHEREAS, on February 17, 1976, the City Council of the City of Carlsbad held a public hearing on the matter and received all recommendations and heard all persons interested in or opposed to the proposed Tentative Map (CT 75-6) revisions; and WHEREAS, said Tentative Map has been declared to have a nonsignificant impact on the environment and a Negative Declaration has been prepared and filed in compliance with the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. C. That the findings of the Planning Commission, in Resolution No. 1215, constitute the findings of the City Council in this matter. D. That City Council Resolution No. 3771, approving this subdivision and establishing conditions therefor, is amended as follows: 1. 2. 3. 4. Amend Condition No. 1 to read as follows: The final map shall be submitted for approval within 18 months from the final action by the City Council on the Tentative Subdivision Map. The final map shall be in substantial conformance with the tentative subdivision map known as Exhibit A and B, dated December 4, 1975. Amend Condition #16 to read as follows: An additional lot, lot 106, shall be created 10' wide along the eastern boundary adjacent to lots 61, 60, 59, and 58. Said lot 106 shall be shown on the final sub- division map and shall be offered for dedication to the City for Open Space purposes concurrent with final map recordation. Combine Conditions 17 and 18 (to be shown as Condition 17) to read as follows: An open space easement over portions of lots 1, 99, 100, 101, 102, and 105, as shown in Exhibit A, dated December 4, 1975, shall be granted to the general public in perpetuity concurrent with final map recordation. Add Condition No. 18 to read as follows: Lot 107 shall be divided as shown on Exhibit C, dated January 21, 1976, with the divisions occurring as follows: Prior to recordation of the final map, a 2.3 acre parcel identified as lot 107A shall be dedicated to the City of Carlsbad for park purposes. Lot 107B shall be identified as 0.8 acre parcel. 2. 5. Amend Condition No. 19 to read as follows: Lots 103 and 104 as shown in Exhibit A, dated December 4 1975 shall be dedicated to the City of Carlsbad for Open Space use concurrent with recordation of the final Map. debris and grading deposits shall be removed from said lot or the unconsolidated fill compacted to the satisfaction of the City Engineer. Prior to dedication of Lot 104, the existing 6. Amend Condition No. 20 to read as follows: An open space easement shall be dedicated to the City of Carlsbad over the portion of Lot 107 identified as 107B. 7. Amend Condition No. 25 to read as follows: A detailed landscape and irrigation plan for all phases of the project, prepared by a landscape architect, shall be submitted to the Parks and Recreation Director and the City Engineer for consideration and approval prior to approval of any building permit for any phase of the project.
