HomeMy WebLinkAbout1976-04-06; City Council; Resolution 3875RES 1 1 1 1 1 1 1 1 1 1 2 2 2, 28 2d 21 2( 2' 21 2< 3( 31 3; UTI c RESOLUTION NO. 3875 OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, VAILING WAGE RATES AS REQUIRED IN PUBLIC WORKS PROJECTS WHEREAS, Section 1773 of the Labor Code of the State of CALIFORNIA SPECIFYING THE GENERAL PRE- :alifornia requires that the general prevailing rate of per diem rages and the general prevailing rates for legal holiday and over- :ime work in the locality in which a contract for public work is to )e performed for each craft, classification or type of workman teeded to execute the contract shall be specified in the call for bids for the contract and in the bid specifications and in the con- .ract itself; and WHEREAS, section 1773 has been amended to provide that in ieu of specifying the prevailing wage rates in such call for bids he awarding body may refer to copies thereof at its principal Iffice; and WHEREAS, the provisions of Section 1773 of the Labor Code f the State of California provide that where the awarding body hooses to refer to a copy of the prevailing wage rate on file at ts principal office in lieu of specifying them in each call for ids, the awarding body shall publish its determination of the revailing wage rates in a newspaper of general circulation at east one time during each year, and, if there is any change in the revailing wage rates during the course of any year, the awarding ody shall specify the changes in the first call for bids made by he awarding body therafter; and WHEREAS, the City of Carlsbad has compiled a schedule of he prevailing wage rate in this area for each craft, classificatior r type of workman needed to execute contracts for public works: anc WHEREAS, a copy of the said schedule, marked Exhibit "A", s attached hereto and incorporated herein by reference thereto; anc 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 WHEREAS, the City Council of the City of Carlsbad, having ieard the testimony of the City Engineer and having reviewed the ;aid schedule determining that the rate of per diem wages and the reneral prevailing rates for legal holiday and overtime work for !ach craft, classification or type of workman needed to execute :ontracts for public works set forth in the said schedule is the revailing wage rate for each craft, classification or type of rorkman needed to execute contracts for public works in this area; NOW, THEREFORE, BE IT RESOLVED by the City Council of the :ity of Carlsbad that the schedule of prevailing rate of per diem Jages and the general prevailing rates for legal holiday and over- :ime work for each craft, classification or type of workman needed :o execute contracts for public works is that set forth in Exhibit 'A", attached hereto and incorporated herein by reference thereto; BE IT FURTHER RESOLVED that, in lieu of specifying the ;aid prevailing wage rates in each call for bids, the City of Carls- >ad shall refer to a copy of the said prevailing wage rates on file iith the City Clerk of the City of Carlsbad. BE IT FURTHER RESOLVED that, if there is any change in thc ;aid prevailing wage rates furing the course of the year, the City >f Carlsbad shall specify such changes in its first call for bids ind any bid call published thereafter; BE IT FURTHER RESOLVED that any contractor whose bid upon i contract €or public works awarded by the City of Carlsbad is xcepted shall be directed to post a copy of the determination of :he prevailing rate of per diem wages and the general prevailing rates for legal holiday and overtime work made by the City Council if the City of Carlsbad at each jobsite; BE IT FURTHER RESOLVED that the City Clerk is directed to Zause the publication of this resolution in the Carlsbad Journal, 2 newspaper of general circulation published in the said City of Zarlsbad. -2- 12 17 18 1' 1( 1' It l! 2( 2: 2: 21 2f 2: 2t 27 2E 29 3c 31 32 PASSED, APPROVED AND ADOPTED at a regular meeting of the day of :ity Council of the City of Carlsbad, California, this 6th April , 1976, by the following vote, to wit: AYES : Councilmen Frazee, Lewis, Skotnicki and NOES : None Councilwoman Casler ABSENT: Councilman Packard ITTEST: seal)
