RESQLUTION NO. 4004
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, DECLARING
THAT CERTAIN PROPERTY, HEREINAFTER DES-
CRIBED, IS NOT REQUIRED FOR PUBLIC USE
AND APPROVING THE SALE OF SAID REAL
PROPERTY.
WHEREAS, the City of Carlsbad is the owner of a parcel herein-
tfter particularly described, which parcel was originally obtained
is a part of State Highway 1-5 widening; and
WHEREAS, said real property is not now needed for public use
tnd is not capable of being used for park or recreational develop-
lent; and
WHEREAS, the Director of Public Works has recommended that
;aid parcel be declared "surplus"; and
WHEREAS, it appears to be in the best interests of the City
:o sell said real property at public auction to the highest
)idder; and
WHEREAS, or1 June 9, 1976, the Planning Commission of the
:ity of Carlsbad did determine that the location, purpose and
?xtent of said real property disposition is in conformity with
:he adopted General Plan;
NOW, THEREFORE, BE IT P.ESOLVED by the City Council of the
:ity of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the City Council hereby finds that the public
interest and convenience necessitates the sale of the hereinafter
lescribed real property.
3. That the City Council hereby declares said property
"surplus" and declares its intention to sell said property at

public auction to the highest bidder.
4. That the City Council hereby declares that said property
is not capable of being used for park or recreational development.
5. That the minimum price for which said property shall
be sold shall be not less than $500.00.
6. That the real property to be sold is situated in the
City of Carlsbad, County of San Diego, State of California,
bounded and described as follows:
That portion of the frontage road (also known as Pi0 Pic0
Drive) relinquished to the City of Carlsbad by the State
of California, Division of Highways, per Relinquishment Map No. 19046, file no. 69239, dated March 23, 1972,
described as foll.ows:
Beginning at the southwest corner of Parcel "A", as
shown on Parcel Map 720, recorded in the Office of the
Recorder of San Diego County, State of California on
January 20, 1972, file no. 15655; thence South 2lo4O116"
East along the easterly right of way and access control
line of State Highway 11-SD-5 (Interstate 5 freeway), a
distance of 254.93 feet; thence continuing aleng said
right of way and access control line South 26 17'40"
East 99.70 feet, to the beginning point of a non-tangent
929.54 foot radius curve concave easterly, a radial line to said point bearing North 64O52'36" East; thence
northerly along said curve 298.12 feet, through a central angle of 18°22'32" to the southeasterly corner of aforementioned Parcel "A", Parcel Map 720; thence North
89O26'43" West 10.84 feet; thence North 31°27'04" West
23.59 feet: thence North 58O29'22" West 39.49 feet to
the Point of Beginning.
7. That the Mayor be authorized to execute a grant deed to
the property to the highest bidder.
