WHEREAS, on February 17, 1976, the City Council did establish
an agricultural preserve on approximately 345 acres of prime agri-
cultural land within the City of Carlsbad; and
WHEREAS, on February 17, 1976, the City Council also approved
the execution of a Land Conservation Contract between the City and
the owner of the property placed into said agricultural preserve;
and
WHEREAS, said contract constitutes an enforceable restriction
for purposes of the County Assessor when valuating the property for
tax purposes; and
WHEREAS, said restricted valuation resulted in a reduced total
valuation for the City, and, subsequently, reduced tax revenues to
the City and other affected taxing agencies; and
MHEREAS, the State through the Open-Space Subventions Act of
1972 has provided for partial replacement revenues to local govern-
ment by reason of the reduction of the property tax on open-space
lands assessed under an enforceable restriction; and
WHEREAS, the State has prescribed regulations to be followed
in applying for State payments for eligible land under enforceable
restrictions; and
WHEREAS, the City desires to make application for said payments.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Carlsbad does hereby authorize the filing of an application

RESOLUTION OF THE CITY COUNCIL, CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING THE FILING OF AN APPLICATION FOR THE STATE OPEN-SPACE SUBVENTION REVENUES AND DESIGNATING AN AUTHORIZED REPRE- SENTATIVE.

designate the City Flanager as its authorized representative in
the preparation and filing of said aDPlication.
