HomeMy WebLinkAbout1977-01-04; City Council; Resolution 4070ll 6 7 8 9 10 11 12 13 RESOLUTION NO. 4070 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING RESOLUTION 4034 CONCERNING APPROVAL OF AN AGREEMENT EMPLOYING PROJECT CONSULTANT authorizing the City Manager to engage JOSEPH SANDY in consultant work on the Encina Public Facilities and Land Use Management Program, and WHEREAS, the agreement shown as Exhibit 'A' to said resolution contained an error in the hourly rate of pay. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad that the previous approval applies except that the hourly rate shown in Exhibit 'A' should read $8.00 per hour in 34lieu of $10.50 per hour. WHEREAS, the City Council has adopted Resolution No. 4034 PASSED, APPROVED, AND ADOPTED by the City Council of the City f Carlsbad at a regular meeting held the 4th day of January I 977, by the following vote, to wit: 18 19 20 21 22 AYES : Councilmen Frazee, Lewis, Packard, Skotnicki and NOES : None Councilwoman Casler A ABSENT: None ROBERT PMcJyL C. FRAZEE, Mayor 23 24 26 27 28 PROJECT CONSULTANT EMPLOYMENT AGREEMENT This agreement is made and entered into by and between the City of Carlsbad, California, a municipal corporation, hereinafter called, the City, and Joseph Sandy, an individual, hereinafter called Sandy, both of whom understand and agree as follows. RECITALS The City desires to employ the services of Sandy as a Project Consultant to the City of Carlsbad. Section I. The City hereby retains and employs Sandy as a Project Consultant to perform the duties, set out herein. Item A. Collect and format base data as required for the Encina Public Facilities Program. Item B. Co-ordinate base data for use in the CPO gridcell program to show relationships between public facilities service areas, existing populations and undeveloped land within the Carlsbad area. Test and analyze usefulness of the Encina Public Facilities Program. Item C. Item D. Assist in preparation of manuals and reports as needed. Item E. Other related duties as required. Section 11. The City agrees to pay Sandy at the rate of $8;oo per hour not to exceed $2,000.00 per month as compensation for the performance of all functions and duties set out herein. Time sheets shall be turned in at the end of two week intervals. This agreement may be terminated at any time for unsatisfactory performance in any of the above phases or for any other reasons as determined by the City of Carlsbad or at the request of the contractor. Section 111. Sandy agrees to perform all duties and functions provided herein. Section IV, 1976, and shall terminate on June 30, 1977, The appointment of Sandy shall begin October 27, Section V. herein as an independant contractor and not as an employee of the City; he shall be under the contract of the City regarding the conduct of the execution of the project, results accomplished and personnel assigned to the project. Section VI. shall be required of Sandy while serving as a Project Consultant.
