HomeMy WebLinkAbout1977-02-01; City Council; Resolution 40871 2 3 4 5 6 7 a 9 1c 11 IS 2c 21 22 2: 24 2: 2E 27 2E RESOLUTION NO. 4087 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, REQUESTING THE CALIFORNIA HIGHWAY PATROL TO ADMINISTER THE CITY'S ABANDONED VEHICLE PROGRAM IN ACCORD WITH CHAPTER 10.52 OF THE CARLSBAD MUNICIPAL CODE. WHEREAS, the City of Carlsbad has by the adoption of Chapter 10.52 of the Carlsbad Municipal Code provided for a program to remove abandoned vehicles from the City in accord with the California Vehicle Code; and WHEREAS, Section 22665 of the Vehicle Code provides that the California Highway Patrol shall, when requested to do so, administer on behalf of the City its abandoned vehicle program; and WHEREAS, the City Council of the City of Carlsbad has determined that it is appropriate to make said request; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the City of Carlsbad has provided for an abandoned vehicle program by the adoption of Chapter 10.52 of the Carlsbad Municipal Code which fully conforms with the provisions of Section 22661 of the California Vehicle Code. 3. Pursuant to Section 22665 of the Vehicle Code the City Council hereby formally requests the California Highway Patrol to administer on behalf of the City its abandoned vehicle abatement and removal program established pursuant to Section 22660 of the Vehicle Code and Chapter 10.52 of the Carlsbad Municipal Code. 4. The City of Carlsbad hereby agrees that they will r .I 1 I 2 of Section 22661 of the Vehicle Code and that the City will reim- II 0 0 conduct any public hearings necessary pursuant to Subsection (d) burse the California Highway Patrol for its costs of administration and removal which the City is authorized to recover from the property owner pursuant to Section 22660 of the Vehicle Code.
