RESOLUTION NO. 5006
A 2ESOLUTIOii OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DETERMINIXG THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIZE THE ISSUANCE OF A CERTIFICATE TO
WESTERN STATES TRANSPGRTATION, INC. DBA YELLOW CAB TO OPERATE FOtiR (4) TAXI CABS IN THE CITY OF CARLSBAD AiiD ORDERING THE CITY CLERK TO ISSiiE - SAID CERTIFICATE SljBJECT TO CERTAIN CONDITIONS.
WHEREAS, Western States Transportation, Inc. dba Yellow Cab
in accord with Chapter 5.20 of the Munfcipal Code has applied for
a Certificate of Convenience and Necessity to operaie taxicab
service within the City of Carlsbad; and
WHEREAS, pursuant to said Chapter, a Public iiearing was held
before the City Councii of the City of Carisbad on March i, 1977,
to determine whether or not the public interest, convenience and
necessity require the issuance of the Certificate appiieti for; and
WHEREAS, at said hearing all persons having .interests in the
matter were heard;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above recitationsare true and correct.
2. That the public interest, convenience and necessity
require the issuance of the Certificate applied fur.
3. That saici Certificate is hereby issued to Western States
Transportation, Inc. dba Yellow Cab Company, subject to the
following terms and conditions:
a) The Certificate permits service throughout the
City of Carlsbad.
b) Four (4) taxjcabs are authorized.

(c) The schedule of fares to be charged shall be: Initial drop $.80 including first 1/8 mile; $.20 for each additional 1/4 mile; $.20 for each minute-and-one- half of waiting time or traffic delay; $1.05 per mile on mileage driven 5 miles or more outside the City limits.
(d) The certificate and the operation of taxi service pursuant thereto shall be subject to all of the provi- sions of Chapter 5.20 of the Municipal Code.
(e) The certificate is issued for an initial period of one year, said period to commence on the date of adoption of this resolution. The City Council may grant two one-year extensions by minute action without holding additional public hearings.
(f) Applicant's application form dated December 29, 1976 shall be part of this certificate and their letter of December 29, 1976 on file in the office of the City Clerk shall be part of this certificate and is incorporated by reference herein.
(9) The City shall have the right to inspect all vehicles at any time to insure they are maintained in safe operating condition.
the attached list, Exhibit "A". (h) Applicant may only use the vehicles listed on
(i) Applicant shall file certificates of insurance in the amounts of $100,000/300,000 with the City Clerk prior to commencing service pursuant to this certificate.
(j) No taxi stands are permitted.
4. That the City Clerk is hereby directed to issue a copy
of this resolution as a certificate in accord with Chapter 5.20
of the Carlsbad Municipal Code.
5. That the certificate shall not be issued until the
applicant has complied with all of the hereinabove terms and
conditions.

the City Council on the 1st day of March , 1977, by the
following vote, to wit:
