mSOLUTION NO. 5016
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING THE LAND USE ELEMENT OF THE GENERAL PLAN TO CHANGE THE LAND USE DESIGNATION FOR TWO AREAS OF THE CITY 'S GENERAL PLAN. APPLICANT: CITY OF CARLSBAD (GPA-43(1) AND (4)).
WHEREAS, the Planning Commission did hold duly noticed
public hearings as prescribed by law to consider amendments to
the Land Use Element of the General Plan on January 12, 1977
(GPA-40) and February 9, 1977 (GPA-43 and 44); and
WHEREAS, the Planning Director has determined that said
amendments will have a nonsignificant impact on the environment
and a Negative Declaration has been prepared and filed in satis-
faction of the requirements of the City of Carlsbad Environmental
Protection Ordinance of 1972 and the California Environmental
Quality Act: and
WHEREAS, the City Council, on February 1, 1977 and on
March 1, 1977 held duly advertised public hearings to consider
said amendments and at said times received the recommendations,
objections, protests and comments of all individuals and parties
who desired to be heard; and
WHEREAS, the City Council, after considering all proposed
changes to the land use element, directed the City Attorney to
return with revised documents to allow the Council to vote on the
changes individually as a part of one single amendment to the
element.
NOW, THEREFO-RE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
A. That the above recitations are true and correct.

B. That this resolution and Resolution Nos. 5014, 5015 and
5017 are all part of a single amendment to the land use element
of the General Plan.
C. That the findings of the Planning Commission as set fort1
in Planning Commission Resolution No. 1322 (GPA-43(1)) and
Resolution No. 1325 (GPA-43 (4) ) constitute the findings of the
City Council.
D. That the land use element of the General Plan is
amended as follows:
1. GPA-43 (1) : Enlarge the limits of the "special
treatment area" designation around the Agua Hedionda Lagoon to
encompass the planning area boundaries of the Agua Hedionda
Specific Plan as shown on map marked Exhibit 1, attached hereto
and made a part hereof.
2. GPA-43 (4) : Change the "Public Utility" designation
to "Travel Services Commercial" designation on approximately six
acres of land on property generally located at the northwest
intersection of 1-5 and CannonRoad as shown on map marked
Exhibit 2, attached hereto and made a part hereof.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 5th day of Apri 1 , 1977
by the following vote, to wit:
AYES : Councilmen Lewis, Skotnicki , Packard, and Councilwoman Casler
NOES : None.
n ABSENT: None.
ABSTAINED: Councilman Frazee.
