RESOLUTION NO. 5052
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING AN AMEND-
MENT TO SPECIFIC PLAN (SP-115), TO DELETE
THEREFROM A PORTION OF THE PROPERTY TO BE
DEVELOPED PURSUANT TO CT 76-15 AND PUD-6, SAID
PROPERTY LOCATED ON THE WEST SIDE OF EL CAMINO REAL BETWEEN KELLY DRIVE AND CHESTNUT AVENUE.
CASE NO. SP-115 (A) - APPLICANT : DOUGLASS-SOUTHFJEST
CORPORATION.
WHEREAS, a verified application was received for deletio
of certain property included within PUD-6 and CT 76-15 from
SP-115, more particularly described as:
That portion of Lot "I" of Rancho Agua Hedionda, in the
City of Carlsbad, County of San Diego, State of California
according to the Map thereof No. 823, filed in the Office of the County Recorder of San Diego County, November 16,
1896, and also listed in Assessor's Book No. Parcels 8 and 9; 207, Page 200,
and
WHEREAS, on March 9, 1977, the Carlsbad City Planning
Commission adopted Resolution No. 1337 recommending to the City
Council approval of amended Specific Plan (SP-115 (A) ) ; and
WHEREAS, the City Council of the City of Carlsbad, on
April 5, 1977, considered the recommendatiordsof the Planning
Commission; and
WHEREAS, an Environmental Impact Report was certified as
complete for a previously issued entitlement for this project,
and the Planning Director has found the amended Specific Plan
(SP-l15(A)) to be in prior compliance with the City of Carlsbad
Environmental Protection Ordinance of 1972;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
A. That the above recitations are true and correct.

B. That the findings of the Planning Commission in
Resolution No. 1337 constitute the findings of the City Council
in this matter except as they relate to the public facilities
element of the General Plan regarding the availability of sewer
service.
The City Council finds that sewer service is not available
for this development as of the date of this approval. However,
sewer service may be available in the future. The City Council
will, by inclusion of an appropriate condition to this anended
Specific Plan (SP-l15(A)), insure that building permits will not
issue unless sewer service is available. Since the project can-
not develop until sewer availability is insured, the Council is
satisfied that the requirements of the public facilities element
of the General Plan have been met insofar as they apply to this
amended Specific Plan.
C. That Specific Plan (SP-115) as approved by Resolution
No. 3177 is hereby amended by the deletion of those portions
within CT 76-15, Resolution No. 5050 and PUD-6, Resolution
No. 5051 as shown on the amended Specific Plan (SP-115(A)) marked
Exhibit ''A'', dated January 25, 1977, on file with the Planning
Department and incorporated herein by reference and by the
addition of a condition as follows:
"NO building permits shall issue for any structure
within SPv115(A) unless the City Manager determines that sewer service is available."

Carlsbad City Council held on the 3rd day of May , 1977
by the following vote, to wit:
