WHEREAS, the Public Employees' Retirement Law permits the
participation of public agencies and their employees in the
Public Employees' Retirement System by the execution of a
contract, and sets forth the procedure by which said public
agencies may elect to subject themselves and their employees
to amendments to said law; and
WHEREAS, one of the steps in the procedure to amend this
contract is the adoption by the City Council of the City of
Carlsbad of a resolution giving notice of its intention to approve
an amendment to said contract, which resolution shall contain
a summary of the change proposed in said contract: and
WHEREAS, the following is a statement of the proposed

the City of Carlsbad does hereby give notice of intention to
approve an amendment to the contract between the City of Carlsbad
and the Board of Administration of the Public Employees'
Retirement System, a copy of said amendment being attached
hereto as EXHIBIT A, and by this reference made a part hereof.

AMENDMENT TO CONTRACT BETWEEN THE
BOARD OF ADMINISTRATION
PUBLIC EMPLOYEES' RETIREMENT SYSTEM
AND THE
C I TY C 0 U N C 1 L
OF THE CITY OF CARLSBAD
The Board of Administration, Public Employees' Retirement
System, hereinafter referred to as Eoard and the City Council of the
City of Carlsbad, hereinafter referred to as Public Agency, having entered into a contract under date of December 23, 1955, effective
January 1, 1956, as amended effective July 1, 1957, January 1,
1959, March 5, 1959, March 18, 1975, and April 1, 1975, which
provide for participation of Public Agency in said System, Board and
Public Agency hereby agree as follows:
A. The fol.lowing subparagr,ph shall be added to Paragraph
5 of said contract:
5.d. Section 20862.8 (providing service credit at
retirement for unused sick leave) for miscel-
laneous members.
B. Paragraph 5.5 shall be added to said contract:
5.5 Public Agency, in accordance with Section 20740,
Government Code, shall cease to be an "employer"
for purposes of Chapter 6 of the Public Employees'
Retirement Law effective as of the effective date
of this amendment to this contract. Accumulated
contributions of the Public Agency as of the date
of such amendment shall be fixed and determined as provided in Section 20759, Government Code, and such
accumulated contributions and contributions here-
after made shall be held by the Board as provided
in Section 20759, Government Code.
C. Paragraph 6 (a) shall be stricken from said contract
and the following 6 (a) shall be substituted therefor:
6. Public Agency shall contribute to said Retirement
System as follows:
a. With respect to miscellaneous members, the
Public Agency shall contribute the following
percentages of monthly salaries earned as
miscellaneous members of said System:
(1) 0.278 percent rintil June 30, 2000, on account of the liability for prior
service benefits.
(2) 8.103 percent on account of the liability
for current service benefits.
D. 'i."his amendment shall be attached to said contract and
