That.Tentative Map (CT 77-8) is hereby approved subject to all applicable requirements of the Carlsbad Municipal Code A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING WITH CONDITIONS TENTATIVE ?4AP (CT 77-8) FOR A 16 LOT SUBDIVISION ON A 5.5 ACRE LOT GENERALLY LOCATED ON THE EAST SIDE OF EL CAMINO REAL BETWEEN ALGA ROAD AND SDG&E EASEMENT. APPLICANT: ROLLY PULASKI & ASSOCIATES. WHEREAS, on June 22, 1977 the Carlsbad City Planning Commission adopted Resolution No. 1375 recommending to the City Council that Tentative Map (CT 77-8) be conditionally approved: and WHEREAS, the City Council of the City of Carlsbad on July 19, 1977 considered the recommendations of the Planning Commission: and WHEREAS, the Planning Director has determined that said Tentative Map will have a nonsignificant impact on the environment and a Negative Declaration has been prepared and filed in satis- faction of the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972 and the California Environmental Quality Act; I NOW, THEREFORE, BE IT RESOLVED by the City Council of the 1 City of Carlsbad as follows: C. The approval is granted for the land described in the application and any attachments thereto and as shown on the plot plan submitted labeled Exhibit C, dated May 19, 1977, on file in the Planning Department and incorporated by reference herein. 2. Park-in-lieu fees shall be paid to the City, to the satisfaction of the Parks and Recreation Director, prior to approval of the final map. 3. Reciprocal easements for ingress and egress shall be granted across property lines traversed by driveways and parking areas, to the satisfaction of the City Engineer. 4. The public street shall not be blocked to restrict access to the north. 5. Street "A" shall be dedicated and improved based on a forty-two foot width (half street plus twelve foot travel lane). 6. El Camino Real shall be dedicated on the basis of a one hundred twenty-six foot street section. shall be constructed along the frontage of El Camino Real. The median 7. The north end of Street "B" shall be constructed as a standard cul-de-sac with a driveway opening to the parcel to the north. 9. Prior to recordation of any final map for the subject property a study of the noise levels of the project lots along El Camino Real shall be made by an accoustica engineer experienced in noise attenuation. shall determine if attenuation measures are necessary to bring noise levels within 65 dB(A) outcloors and 45 dB(A) indoors. Said study shall recommend such attenuation measures as deemed necessary and approved by the Planning Director. Said measures shall be incorporated in the site design and building plans for said lots as a condition of the Specific Plan or added as conditions to the Tentative Map approval, Said study /// 10. This subdivision is approved on the express condition that the final map shall not be approved unless the City Council finds as of the time of such approval that sewer service is available to serve the subdivision. 2. 1 2 3 4 5 6 7 8 9 10 11 This Tentative Subdivision Map shall be subject to any further approvals as may be necessary in connection with such plan for the allocation of sewer service among competing uses as the City Council may adopt. If an allocation plan is adopted prior to final map approval, the applicant shall satisfy the requirements of such plan as a further condition of this Tentative Subdivision Map approval. 12 0 13. All requirements and recommendations found under mitigating measures on Pages 39, 40 and 41 of the Archaeological Evaluation prepared for this project, on file in the Planning Department and incorporated by reference herein, shall be accomplished by the developer. The work required by said measures shall be monitored by the Planning Department. archaeologist shall consult with the Planning Department during the course of the work. If, in the Planning Director's judgment, additional mitigating measures are necessary in light of the information developed during the course of the work, he shall have the authority to impose them. If, in his judgment, signifi- cant modifications to the Tentative Subdivision Map are necessary, he shall return the matter to the City Council for action as they consider appropriate.
