HomeMy WebLinkAbout1977-08-16; City Council; Resolution 517712 0 a- 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 5177 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING WITH CONDITIONS TENTATIVE MAP (CT 77-7) TO PROVIDE 28 LOTS ON 7.4 ACRES IN AN EXISTING R-1 AND R-1-10,000 ZONE, GENERALLY LOCATED ON THE SOUTH SIDE OF ELM AVENUE BETWEEN VALLEY STREET AND HIGHLAND DRIVE. APPLICANT: RAY STOCKTON. WHEREAS, on June 22, 1977 the Carlsbad City Planning Commission adopted Resolution No. 1376 recommending to the City Council that Tentative Map (CT 77-7) be conditionally approved; and WHEREAS, the City Council of the City of Carlsbad on August 2, 1977 considered the recommendations of the Planning Commission; and WHEREAS, the Planning Director has determined that said change of zone will have a nonsignificant impact on the environ- ment and a Negative Declaration has been prepared and filed in satisfaction of the requirements of the City of Carlsbad Environ- mental Protection Ordinance of 1972 and the California Environ- mental Quality Act; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A, That the above recitations are true and correct. B. That the findingsof the Planning Commission in Resolution No. 1376 constitute the findings of the City Council in this matter. C. That said Tentative Subdivision Map, together with the provisions for its d9sign a.rtd improvement and subject to the conditions of this resolution, is consistent with all applicable general and specific plans of the City of Carlsbad. 1; L3 1s 2c 21 22 23 24 25 26 27 28 D. That Tentative Map (CT 77-7) is hereby approved subject to all applicable requirements of the Carlsbad Municipal Code and to the satisfaction of the following conditions: 1. 2. 3. 4. 5. 6. 7. The approval is granted for the land described in the application and any attachments thereto and as shown on the plot plan submitted labeled Exhibit A, dated June 8, 1977, on file in the Planning Department and incorporated by reference herein. Park-in-lieu fees shall be paid to the City prior to approval of the final map. This subdivision is approved on the express condition that the final map shall not be approved unless the City Council finds as of the time of such approval that sewer service is available to serve the subdivision. This subdivision is approved upon the express condition that building permits or grading permits will not be issued for development on the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such permit and will continue to be available until time of occupancy. If the City Engineer determines that sewer facilities are not applicable, building permits will not be issued until arrangements satisfactory to the City Council can be made to guarantee that all necessary sewer facilities will be available prior to occupancy. This condition shall be noted on the final map. This Tentative Subdivision Map shall be subject to any further approvals as may be necessary in connection with such plan for the allocation of sewer service among competing uses as the City Council may adopt. If an allocation plan is adopted prior to final map approval, the applicant shall satisfy the requirements of such plan as a further condition of this Tentative Subdivision Map approval Additional dedication along the Highland Street frontage (lot 28) shall be provided prior to recordation of the final map, to the satisfaction of the City Engineer. All public improvements shall be installed on Valley Street, Oak Avenue, Elm Avenue and Highland Drive to City standards except for a modified street section adjacent to lot 28 which would allow for 2. 1 2 3 4 5 6 7 8 9 10 I1 c - 1E 1s 2c 27 22 2: 24 2E 2E 27 2E 0 8. 9. the retention of approximately 12 mature pine trees located within the existing right of way. The improvements adjacent to Lot 28 shall be to the satisfaction of the City Engineer. Additional right of way along lot 28 may be required to facilitate the retention of these trees. The official City engineering standard specifications as adopted by Resolution 1843 are hereby modified as they apply to this subdivision in accordance with this condition. The applicant shall pay reimbursement fees for sewer and storm drain facilities to the satisfactio~ of the City Engineer, prior to recordation of the final map. A six foot decorative masonry wall as approved by the Planning Director shall be constructed along the rear lot lines adjacent to Elm Avenue prior to the issuance of final occupancy of the affected units. 10. All public improvements shall be constructed as shown on the tentative map, PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 16thday of Auqust , 1977 by the following vote, to wit: AYES : Councilmen Frazee, Lewis, Skotnicki and Councilwoman Casler NOES : None ABSENT : Councilman Packard FRAZEE, Mayor ATTEST z 3.
