WHEREAS, the City Council of the City of Carlsbad has determined that certain revisions are necessary in the First Phase Sewer Allocation System adopted by Resolution No, 5199 pursuant to Section 18.05.030 of the Carlsbad Municipal Code; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the First Phase Sewer Allocation System, Exhibit r'S'r to Resolution No. 5199, is hereby superseded by a revised First Phase Sewer Allocation System as set out in Exhibit "S" Revised, dated November 15, 1977, attached hereto and made a part hereof. 3. The Revised First Phase Sewer Allocation System shall be subject to all the terms and conditions of this resolution and Resolution No, 5199. FIIiST PI€ASE SEWER ALLOCATION SYSTEM Obiectives The sewer allocation system contained herein is intended to provide a framework within which the City Council can make some judgements re- garding the allocation of a limited amount number of sewer capacity which may become available. objectives : This system is designed to meet the following City A. To fairly and equitably allocate a limited amount of sewer capacity among competing demands. B. To coordinate ' development with needed pub1 ic improvements. C. To maintain.and enhance levels of City services (infilling). D. To preserve and/or e&ance the efficiency of service delivefy systems to allow time to provide public facilities adequate to meet expanded service needs. E. To renew and maintain existing urbaxareas. F. To develop vacant land that is within exist.ing urban areas and is currently serviced by public facilities; i.e., streets, water, sewer. 11. Available Sewer CaDacity It is estimated that the first phase sewer allocation system will have 270 number of equivalent dwelling units and 75,000 gallons of sewer treatment capacity to be considered for allocation. This sewer allocation system is responding to the specific needs of the community in terms of those persons known or unknown who have bken caught by the sewer moratorium established April 19, 1977. The City Council has determined to consider allocating sone or all of the leased sewer capacity which we have acquired covering such concerns as: 1) distribution of sewer capacity by percentage to specific land use categories; 23 creating a rating system within the various land use categories; 3) establishing community benefits for the City of Garlsbad as the maior allocation criteria: and 41 develoment of a system to fairly recognize those persons affected'by the koratorium ;€ April 19, 1 a77 LJI I. It may be necessary to establish a separate rating system for these two categories if a high demand occurs; how- ever, at this time it is anticipated that these will be handled on an "as needed" basis by a case-by-case evaluation by the City Council. The only exception to the City Council allocating these two categories based on comity need and the public welfare, is that the City Manager shall have authority to issue sewer connection permits for failing septic tank systems. It is anticipated that V. - Procedures for Applying for Sewer Permits Under the First Phase Allocation System A. Staff Evaluation After the closing date for receipt of applications, a staff commi consisting of the Public Works Administrator, City Engineer, Dire of Building and Housing and the Director of Planning, shall evalu each application in accordance with the provisions of this sectio The committee shall prepare a report for the City Council. The r shall show which projects in the judgment of the committee meet t qualifications of Section V. for each project based on the staff judgment of the projects rank after applying the point system as set out in the Rating System Questionnaire, a part of Exhibit B, attached hereto and made a pa hereof. City Council Action The City Clerk shall set a public hearing before the City Council to consider the staff committee report. public hearing on the report, the Council shall first consider an( resolve any disagreements between applicants and staff in regards to the qualifications of Section V. If the Council is not satisfied that the results of the -ratfng- system meet the objectives and purposes an( intent of the system, the Council may amend it as they consider ,necessary in the public interest. Ihen the Council is satisfied with the findings aJld the ranking of the projects, they shall ado1 a list of such projects which shall become the basis for issuing sewer permits and building permits in the Carlsbad sewer district boundaries. Inclusion of a Droject on the approved list shall COI stitute authorization pursuant to Municipal Code Section 18.05.03( for the exception of that project from the building moratorium im posed by Chapter 18.05 of the Code. The Council is under no obligation to allocate all or any part of the available sewer capacity pursuant to this system.
