REISOLUTION NO. 5380
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING
THE CITY ATTORNEY TO REJECT, PAY OR
COMPROMISE CLAIMS AGAINST THE CITY IN
THE AMOUNT OF $500.00 OR LESS.
WHEREAS, the City's liability insurance policy carries a
$500.00 deductible and the City's automobile policies carry a
deductible for collision of $500.00 and comprehensive of $200.00;
and
WHEREAS, the Council desires to delegate the authority to
determine the proper disposition of claims in amounts equal to
or less than said deductible amounts to the City Attorney;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California as follows:
1. That the above recitations are true and correct.
2. That the City Council hereby authorizes the City Attorney
to determine t.he appropriate disposition of claims against the
City for general liability in the amount of $500.00 or less, for
damages to aut.omobiles in the amount of $500.00 or less for
collision or $200.00 or less for comprehensive. The Attorney's
written endorsement that a claim within the above amounts should
be paid will cause the Finance Director to issue a warrant in
said amount. The City Attorney shall have authority to deny,
approve for payment or compromise any such claims as he determines
appropriate.

PASSED, APPROVED AND ADOPTED at a regular meeting of the
Lty Council of the City of Carlsbad on the 18th day of
Apri 1 , 1978, by the following vote, to wit:
AYES : Councilmen Packard, Skotnicki, Anear and
Councilwoman NOES : None
ABSENT: None
