HomeMy WebLinkAbout1978-08-01; City Council; Resolution 54961 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 5496 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, PROVIDING FOR THE FILING OF REBUTTAL ARGUMENTS FOR CITY MEASURES SUBMITTED AT MUNICIPAL ELECTIONS. WHEREAS, Section 5014.5 of the Elections Code of the State of California (effective January 1, 1978) authorizes the City Council, by majority vote, to adopt provisions to provide for the filing of rebuttal arguments for city measures submitted at munici- pal elections; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS : SECTION 1. That pursuant to Section 5014.5 of the Election Code of the State of California, if any person submits an argument against a city measure, and an argument has been filed in favor of the (city measure, the City Clerk shall immediately send copies of that argument to the persons filing the argument in favor of the city measure. The persons filing the argument in favor of the city measiire may prepare and submit a rebuttal argument not exceeding 250 words. The City Clerk shall send copies of the argument in favor. of the measure to the persons filing the argument against the city measure, who may prepare and submit a rebuttal argument to the argument in favor of the city measure not exceeding 250 words. The rebuttal arguments shall be filed with the City Clerk not more than 10 days after the final date for filing direct arguments. Rebuttal arguments shall be printed in the same manner as the direc arguments. Each rebuttal argument shall immediately follow the direct argument which it seeks to rebut. 1 2 3 I Section 2.
