L >- 4 I RESOLUTION 30. 5673 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, UPHOLDING THE PLANNING COMMISSION RECOMMENDATION AND DECISION AND DENYING THE APPEAL OF A VARIANCE (V-281) TO ERECT A 100 SQUARE FOOT FREESTANDING REAL ESTATE SIGN ON PROPERTY GENERALLY LOCATED AT THE SOUTH- WEST CORNER OF PALOMAR AIRPORT ROAD AND YARROW DRIVE. APPLICANT: GRAPHIC SOLUTIONS. WHEREAS, the Planning Commission of the City of Carlsbad did on July 12, 1978 hold a duly noticed public hearing to considei the application of Graphic Solutions for a variance (V-281) to erect a 100 square foot freestanding real estate sign, instead of the 25 square foot sign permitted, on property generally located at the southwest corner of Palomar Airport Road and Yarrow Drive, more particularly described as: Lot 13 of Carlsbad Tract No. 73-49, CC&F Palomar Airport Business Park -- Unit No. 1 in the City of Carlsbad in the County of San Diego, State of California, according to Map thereof 8054 filed in the Office of the County Recorder of San Diego County on December 31, 1974. and ; WHEREAS, the subject application has been declared to be categorically exempt from the provisions of the City of Carlsbad Environmental Protection Ordinance of 1972; and WHEREAS, at the conclusion of said hearings the Planning Commission denied the variance; and WHEREAS, the applicant filed an appeal with the City Council of the determination of the Planning Commission seeking relief from said denial; and WHEREAS, a duly noticed public hearing was held by the City Council on August 15, 1978 to consider the appeal of said denial 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 at which time all persons interested in or opposed to and the decision of the Planning Commission, considexel it were heard I NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. 2. That the above recitations are true and correct. That the findings of the Planning Commission as set forth in Planning Commission Resolution No. 1455 constitute the Eindings of the City Council. 3. That the City Council hereby denies this appeal and 3ffirms the decision of the Planning Commission to deny the Jariance (V-281). PASSED, APPROVED AND ADOPTED at a regular meeting of the 5ty Council of the City of Carlsbad on the 5th day of SeDtember , 1978, by the following vote, to wit: Council woman Casler AYES : Councilmen Packard, Skotnicki, Anear, Lewis and NOES : None :SEAL) 2.
