RESOLUTION NO. 5570
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING
THE CITY ATTORNEY TO COMPROMISE A CLAIM
FILED AGAINST THE CITY BY WSELOH
CHEVROLET.
WHEREAS, on October 11, 1978, Weseloh Chevrolet filed
a claim against the City of Carlsbad in the amount of $2500.00
alledging that since the City issued a permit for the construction
of a sign which was later determined to be in violation of City
ordinances, the City is responsible for the costs of relocating
the sign; and
WHEREAS, the City Attorney has recommended that, while
the City should not admit responsibility for any of the costs
incurred by lileseloh Chevrolet, that it is in the best interests
of the City to compromise the claim; and
WHEREAS, the City Council concurs with the City Attorney
recommendation;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the City Attorney is authorized to compromise
the claim filed by Weseloh Chevrolet and in that regard, the City
Council authorizes the payment of $1200.00 to Weseloh Chevrolet;
said payment to be conditioned upon receipt of a release of all
claims for liability against the City in regards to the sign from
Mr. Weseloh in a form acceptable to the City Attorney.
PASSED, APPROVXD AND ADOPTED by the City Council of the
City of Carlsbad, California at a regular meeting held on the
