APPL1CANT:R. E. WILKINSON. WHEREAS, the Planning Commission of the City of Carlsbad did on October 25, 1978 hold a duly noticed public hearing to consider the application of R. E. Wilkinson for a Planned Unit Development Permit for four units on property generally located on the west side of El Camino Real between Chestnut and Tamarack Avenues, more particularly described as: Lot 1 of Rancho Agua Hedionda, in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 823, filed in the Office of the County Recorder of San Diego County on November 5, 1896; and WHEREAS, the Planning Director has determined that said change of zone will have a nonsignificant impact on the environment and a Negative Declaration has been prepared and filed in satis- faction of the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972 and the California Environmental Quality Act; WHEREAS, at the conclusion of said hearing the Planning Commission of the City of Carlsbad adopted Resolution No. 148.2; and WHEREAS, on November 21, 1978 the City Council held a public hearing on the matter and received all recommendations and heard all persons interested in or opposed to the approval of Planned Unit Development Permit (PUD-11); 2 3 4 9 10 11 12 0 d L u 18 19 20 21 22 1 23 24 25 26 27 28 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That the findings of the Planning Commission in Resolution No. 1482 constitute the findings of the City Council in this matter. C. That the Planned Unit Development Permit is granted for the reasons set out in this resolution and subject to all applicable requirements of the Carlsbad Municipal Code and to the satisfaction of the following conditions: 1. The approval is granted for the land described in the application and any attachments thereto, and as shown on the plot plan submitted, labeled PUD-11, Exhibit "B" and dated 3ctober 25, 1978, on file in the Planning Department and incorpor- ated by reference herein. Development of the site shall occur substantially as shown on said plot plan, 2. Development shall be in accordance with the criteria and standards set forth in Sections 21.45.110 and 21.45.120 of the Carlsbad Municipal Code and all other pertinent standards of said Code. 3. This project is approved based on the assumption that each lot can be served by a septic system. Sewer service is not available for this project. Building permits will not issue unless the City Engineer certifies that provisions have been made to construct the septic system. 4. The following shall be accomplished to the satisfac- tion of the City Engineer: a. The access road shall have a minimum width of 24' and shall have a tipped section with 6" P.C.C. curb and 12" P.C.C. gutter along the low side: b. Paving of the access road shall meet the City's street improvements standdrds; c. Private access road to be located and centered within a 40' easement. The purpose of said easement to be for a private road, general utility and access easement. Two shall be provided Half street improvements for E1 Camino Real along the property frontage shall be provided. Said improvements may include a street light but not median improvements; There shall be a smooth 18' transition with maximum 5% grade, of the private access road where it intersects the frontage road, with adequate provisions for drainage; The frontage road in the Old El Camino Real right-of-way shall be extended north from the exiting paving to a point 37' north of the center line of the proposed private access road; The structural section of the road shall be determined by the "R" values of the native soil; All grading will be done in accordance with City standards. Newly graded areas shall be planted for erosion control as soon as grading is complete; Drainage from the site shall be conducted from the\si.de via the private access road, in concrete pipes or air blown mortar swales and disposed of in the ABM ditch on the west side of El Camino; A dry sewer system shall be constructed along the El Camino Real frontage and in the utility easement to serve all four units. A 6" looped water main shall be extended from El Camino Real to the existing main on Skyline Road. ' fire hydrants as indicated on the site plan, , to the satisfaction of the Fire Marshall. 6. A complete landscape and irrigation plan shall be submitted to the Planning Department for approval prior to the issuance of building or grading permits. Said plan will show areas of native vegetation to be preserved. The design of the landscape and irrigation plan shall incorporate water conservat,on measures. 7. Each lot shall provide two covered parking spaces for occupants and one off-street parking space for visitors. 8. Parking will not be allowed on the private access road. No parking signs shall be. posted. 9. A parcel map shall be recorded prior to issuance of building permits. Said parcel map to be processed concurrent with this PUD application, 3. f I/ 1 2 ~ 10. All four units shall have an address from El Camino Real and not the private access road. 8 9 14. The roofs of all four units shall be constructed of noncombustible material, 15. For purposes of future additions to the four units: LO 11 a. R-1 setback standards shall apply; 12 a b. Front setbacks shall be taken from the nearest edge of the private access road easement. 16. Any work in the limits of the frontage road shall be conducted in such a manner that continued access to the two homes using said road will be assured. 17. The indicated pad elevations of Exhibit "B", dated October 25, 1978 shall be complied with within a tolerance of +6 inches and -2 feet. 18.
