HomeMy WebLinkAbout1979-04-03; City Council; Resolution 57311 2 3 4 5 6 7 8 9 10 11 12 n a- 0 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 5731 A RES~LUTION OF THE CITY COUNCIL OF THE CITY 4F CARLSBAD, CALIFORNIA, ESTABLISHING REVISED STANDARDS FOR THE AMOUNT OF FEES TO BE /REQUIRED AS A CONDITION OF APPROVAL FOR RESIDENTIAL DEVELOPMENTS WITHIN CERTAIN AREAS !OF THE SAN MARCOS UNIFIED SCHOOL DISTR~CT. ~~ WHEREAS, pdrsuant to Chapter 4.7, Division 1, Title 7 of the California Government Code, the City Council of the City 3f Carlsbad, California has adopted a School Facilities Iedication and Fee Ordinance (Carlsbad Municipal Code Chapter 21.55); and WHEREAS, Section 21.55.150 of the Carlsbad Municipal :ode provides that the standards for the amount of fees to 3e required pursuant to such ordinance shall be determined 2y the City Council and set by resolution. getermination is, to be made after consideration of recommendations The City Council's Erom the governing board of the affected school district; and WHEREAS, the City Council, by the adoption of Resolution \Jo. 5582, established said standards for certain areas of the :ity within the San Marcos Unified School District; and WHEREAS, the City Council is in receipt of recommendations Eor revisions to the amount of fees from the San Marcos Unified School District. Thekr recommendations are attached hereto 3s Exhibit A, and are made a part hereof; and WHEREAS, the City Council fully considered the matter at their regular meeting of February 20, 1979, at which all persons lesiring to speak on the matter were heard, after which the 3ity Council determined to concur in the standards as recommended 3y the Board of 'the San Marcos Unified School District; 1 2 3 4 5 6 7 €3 9 10 11 12 0 19 20 21 22 23 24 25 26 27 28 NOW, THEREFORE, BE IT =SOLVED by the City Council of the ~ City of Carlsbaj as follows: A. That the above recitations are true and correct. B. That the standard for the amount of fees to be required as a condition &f approval for residential developments within that portion of,the City of Carlsbad, which is also within the boundaries of tie San Marcos Unified School District, shall be as contained in Exhibit A. C. This determination is based upon the City Council's concurrence in the recommendations made by the Governing Board of the San Marcos Unified School District, including the facts supporting such recommendations as contained in Exhibit A. D. Unless the decision-making body especially determines to the contrary, the City Council hereby determines that the following findings and requirements shall apply to any residential I development of fifty units or less: 1. All such developments shall be required to pay fees in accordance with the schedule in Exhibit A. 2. The City Council has reviewed that portion of the General Plan which applies to the San Marcos Unified School District and finds that it provides for the location of public schools. 3. That $he fees to be paid shall be used for the purpose of providing interim school facilities. 4. That the fees to be paid for each unit bear a reasonable relationship to the burdens placed on the School District by such unit and that the fees will be used to mitigate that burden. E. The standards adopted by this resolution do not at this time requiqe the dedication of land. The San Marcos Unified School District,is developing standards regarding such iiedications. When the District is prepared to make their 2. recommendation in that regard, the City Council intends to amend this resolution to include provisions for requiring the Iedication of land as they determine to be in the public interests. , F. That Resolution No. 5582 is rescinded. Best indications at thjs point is that this rate will increase in th- e near future. A modest 10% inflation factor is ,-included, At the present time, 19% of the district's classroams are devoted to specjal education classes. This proportion is Tncreasing markedly due to Federal cap. The student generatio( factors computed by the San Diego Department of Education for the San /!4arcos Unified School District are 0.77 students per dwelling unit in single family dwellings and 0.28 for attached dwelling units. (apartments, condoniniums, etc.) Accordingly, the cost to house the students generated per dwelling uni-t becomes $1,188 for single family units and $432 for attached units. j It is assumed that thL average single #amfly dwe?l jng unit in' San 'Marcos'has three bedrooms, so thb cost per bedroom becones $396; $1,188 per dwelling unit - 3 bedrooms per'dwelling unit, dwelling unit has two1 bedrooms, so the cost per bedroom is $276. The reason for assessing the fee' on a per-bedroom basis is that the number of bedrooms has some positive rellation to the nqber of children in the family, .
