HomeMy WebLinkAbout1979-04-17; City Council; Resolution 57441 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 5744 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, IN OPPOSITION TO SENATE BILL NO. 4-62, RELATING TO OUTDOOR ADIERTISING. WHEREAS, the appearance of a community and the health, safety and welfare of its inhabitants is solely a matter of local concern: and WHEREAS, regulation of outdoor advertisement can have a direct effect on the appearance of a community, which thus impacts the economy and the welfare of its citizens; and WHEREAS, the antique characteristics of communities through- out California require individualized zoning treatment; and WHEREAS, statewide regulation of signing and outdoor adver- tisement cannot adequately deal with local needs; and WHEREAS, abatement of non-conforming uses through the exercise of the police power with a period of amortization has been recognized by municipalities and the courts as a reasonable procedure for many years; and WHEREAS, the elimination of said right of cities without remuneration to the property owner would have a serious adverse impact on the economy of cities desiring to enhance their environments; and WHEREAS, the hereinafter proposed legislation would provide a windfall to one particular type of property owner without any reasonable justification therefore; and WHEREAS, the Supreme Court of the State of California has recently approved abatement with amortization as a constitutional and lawful means of eliminating non-conforming uses: and WHEWAS, Senate Bill No. 462 (ZeneVich) , by requiring state- wide requlation in the area of outdoor advertisement would severe1 limit the ability of a City to deal with its particular (zoning) problems and would constitute an unwarranted interference with matters of local concern, and an invasion of local police powers. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CARLSBAD AS FOLLOWS: 1. That the City Council of the City of Carlsbad is opposed to Senate Bill No. 462 (Zenevich). 2. Resolution to the appropriate representatives in the legislature.
