HomeMy WebLinkAbout1979-08-07; City Council; Resolution 5874t *' 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 5874 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD CLARIFYING OCCIDENTAL PARK LAND DEDICATIONS AS RELATED TO CARLSBAD MUNICIPAL CODE SECTION 20.44.110 WHEREAS, the CIty Council of the City of Carlsbad approved Master Plan-133 via Ordinances 9245, 9246, and 9247, dated January 6, 1979; and WHEREAS, said Master Plan envisioned centralized park and other required public facilities; and WHEREAS, subsequent to adoption of MP-133, Carlsbad Municipal Code Section 20.44.110(4) was created to permit dedication of park land outside of individual subdivisions subject to the inclusion of such provisions within an adopted Master Plan; and WHEREAS, the parks provisions of MP-133 originally envisioned a procedure similar to the "alternative procedure" as contained in Carlsbad Municipal Code Section 20.44.110(4) as witnessed by the following: a) Item By paragraph 2, of staff report dated 11/19/69 stated "The master plan also designates the general location of schools, park and fire station sites . . . It b) Memo from Parks and Recreation Commission to Planning Com- mission dated November 14, 1969, stating that it viewed ''with pleasure the joint school park and . . . aspects as indicated by plans presented by the Planning Department." c) Planning Commission resolution 994, dated November 13, 1973, s$ated, in condition #1, line 29, that "Prior to the recordation of the final map, lots 100 and 101, minus the previously dedicated four acres, shall be dedicated to the City of Carlsbad for public 6 , c 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 and school purposes. Future development in the remainder of the property considered under the approved Occidental Master Plan shall receive credit on their parks and school requirements from these two lots." d) City Council resolution 3503 dated September 3, 1974, conditio] 1, line 25, carried the Planning Commisson intent forward by clarifying that lot 100 would be dedicated to Carlsbad Unified School District and that lot 101 would be dedicated to the City of Carlsbad prior to permit issuance. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: Based upon the recitals set forth above it is found that MP-13: anticipated a process essentially the same as that in Municipal Code Section 20.44.110(4) "alternative procedure" and that the provisions of said section are hereby explicitly applied to all future development taking place under the terms and conditions of MP-133 and associated documents.
