HomeMy WebLinkAbout1979-10-02; City Council; Resolution 59501 2 3 4 5 6 7 8 9 10 11 12 0 1: 2( 21 2; 2; 24 2: 2t 2: 2t RESOLUTION NO. 5950 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, GRANTING AN APPEAL OF A PLANNING COMMISSION DECISION APPROVING PHASE a OF A SITE DEVELOPNENT PLAN (SDP 79-3) FOR A 3600 SQUARE FOOT MEDICAL-DENTAL AND GENERAL OFFICE COMPLEX ON A .,53 ACRE SITE GENERALLY LOCATED AT THE SOUTHWEST COWER OF PI0 PIC0 DRIVE AND LAS FLORES DRIVE BY THE AMENDMENT OF THE FINDINGS AND CONDITIONS OF APPROVAL. WHEREAS, the Planning Commission of the City of Carlsbad, California did on August 22, 1979, after public hearing, adopt Resolution No. 1543, which is herewith referred to and made a part hereof, approving Site Development Plan (SDP 79-3) construct a 3600 square foot medical-dental and general office complex on a .53 acre site generally located at the southwest corner of Pi0 Pic0 Dri~~e and Las Flores Drive, more particularly described as: A portion of Lot 4 in section 31, Township 11 South, City of Carlsbad, according to U.S. General Survey approved December 27, 1870, and WHEREAS, on September 4, 1979 a proper appeal of said decision was filed; and WHEREAS, said Site Development Plan has been declared to have a nonsignificant impact on the environment and a Negative Declaration has been prepared and filed in compliance with the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972; WHEREAS, a duly noticed public hearing was held by the City Council on September 18, 1979 to consider the appeal and hear and consider all testimony, reports and communications t presented. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A, That the above recitations are true and correct. B. That the findings of the Planning Commission in Resolution No, 1543 constitute the findings of the City Council with the exception of Finding 2.F. which has been revised as follows: "2.F. At this time, the City Council is not prepared to find that all other public facilities necessary to serve this project will be available concurrent with need. City Council has, by inclusion of an appropriate condition, required that the project contributed to the costs of such facilities, share of the public facilities which it will require, the City Council is satisfied that the requirements of the public facilities element of the general plan have been satisfied.
