HomeMy WebLinkAbout1980-05-06; City Council; Resolution 61691 2 3 4 5 6 7 € s 1c 11 8 $ RESOLUTION NO. 6 69 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING WITH CONDITIONS TENTATIVE MAP (CT 79-27) FOR A 294-UNIT CONDOMINIUM PROJECT AND APPROVING CONDOMINIUM PERMIT (CP-44) FOR SAID PROJECT 29.6 ACRES GENERALLY LOCATED WEST OF EL CAMINO REAL AND ON THE NORTH AND SOUTH SIDES OF HOSP WAY. APPLICANT: BROADMOOR HOMES. WHEREAS, on March 26, 1980 the Carlsbad Planning Commission adopted Resolution No. 1611 recommending to the City Council that Tentative Map (CT 79-27) and Condominium Permit (CP-44) be conditionally approved; and WHEREAS, the City Council of the City of Carlsbad, on April 15, 1980, held a public hearing to consider the recommenda- tions of the Planning Commission and to receive all recommendation: and hear all persons interested in or opposed to Tentative Sub- division Map (CT 79-27) and Condominium Permit (CP-44); and WHEREAS, said Tentative Subdivision Map and Condominium Permit have been declared to have a nonsignificant impact on the environment and a Negative Declaration has been prepared and filed in compliance with the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972; NOW, THEREFOREf BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: A. That the above recitations are true and correct. B. That the findings of the Planning Commission in Resolution No. 1611 constitute the findings of the City Council in this matter. C. That said Tentative Subdivision Map, together with the provisions for its design and improvement and subject to 1 2 3 4 5 6 7 8 9 10 11 the conditions of this resol tion, is consist applicable general and specific splans of the nt with all City of Carlsbad. D. That Tentative Subdivision Map (CT 79-27) and Condominium Permit (CP-44) are hereby approved subject to all applicable requirements of the Carlsbad Municipal Code and to the satisfaction of the following conditions: 1. Approval is granted for CT 79-27/CP-44 as shown on Exhibits A, B, C, D & E to CT 79-27/CP-44 dated February 22, 1980, on file in the Planning Department and incorporated by reference. Development shall occur substantially as shown on these exhibits unless otherwise noted in these conditions. 2. The applicant shall prepare a reproducible copy of the final condominium site plan incorporating all requirements of the condominium permit approval and shall be subject to the approval of the Planning Director prior to approval of the final map for Phase I. 3. The subject property shall be subject to the RD-M zoning standards as they relate to permitted and conditional uses, building height, and setbacks and yards. the applicant shall submit a revised landscape and irrigation plan subject to the approval of the Planning Director. Said Plan shall include changes to the landscaping as required by the Parks and Recreation Director, plus additional pedestrian pathways, stairways, sidewalks and crosswalks. Said plan shall address adequate screening of all structures, in additional to convenient access between the units and the recreational open space areas and parking areas. Said landscape plan shall also include embossed pedestrian crosswalks. 5.
