RESOLUTION NO. 6239
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AN AGREEMENT BETWEEN THE CITY OF CARLSBAD AND THE CARLSBAD BOYS AND GIRLS CLUB FOR LITTER REMOVAL SERVICES.

1s follows:
1. That qn agreement between the City of Carlsbad and the Carlsbad
Boys and Girls ;Club for services relative to removal of litter from City
rights-of-way,;a copy of which is attached hereto, marked Exhibit "A" and
i made a part hereof, is hereby approved.
2. That the Mayor of the City of Carlsbad is hereby authorized and i
directed to execute said agreement on behalf of the City of Carlsbad.

PASSED, ATPROVED, AND ADOPTED at a regular meeting of the Carlsbad
, 1980, by the City Council held on the 15th day of July

AGREEMENT FOR PROVIDING LITTER REMOVAL SERVICES
I I This qgreement entered into this day of , 1980
by and between the City of Carlsbad, a municipal corporation of the State of
Cal i forni a , herii nafter referred to as "Carl sbad" and the Carl sbad Boys and
Girl s C1 ub , herei nafter referred to as "C1 ub" .
I 'WITNESSETH :
WHERE&, Carl sbad is engaged in various street maintenance programs 1
including street sweeping to promote the safety, health and general welfare
of its citizens and;
I
WHEREAS, Carlsbad has been awarded grant funds from the State of
California specifically designated for the purposes of 1 itter removal and;
I
WHEREk, it is deemed appropriate to accomplish litter removal from
the City rights-of-way by agreement with the Club and; I
WHEREAS, the Club can provide litter removal service for just
compensation and in the public interest; I
NOW, HEREF FORE, IT IS AGREED as ~O~IOWS:
SECTION 1 DUTIES OF CARLSBAD

A. Provide appropriate warning signing, equipment and disposal of

Provide appropriate inspection of the cleared areas.
Reimburse the Club on a monthly basis in the amount of $400.00
oh the condition of faithful performance of litter removal.

SECTIOIN 6 HOLD HARMLESS AGREEMENT Carlsbad, its officers and
emplo yl lees shall not be liable for any claims, liabilities, penalties
es or any damage to goods, properties or effects of any person
whateder, or personal injuries to or death of them caused by, or
resulTing from, or claimed to have been caused by, or resulting froms
any a& or omission of Carlsbad, itsof:flikers or employees.
further agrees to indemnify and save free and harmless Carlsbad and
its authorized officers and employees, against any of the foregoing
liabiliities and claims thereof, and any cost and expense that is
incuried by the City on account of any claim thereof.
