HomeMy WebLinkAbout1980-08-05; City Council; Resolution 62631 2 3 4 5 6 7 8 9 10 I1 1% 12 14 1E I€ 17 1E 1s 2( 2: 2; 2: 21 2! 2t 2' 21 RESOLUTION NO. 6263 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA URGING THE LEAGUE OF CALIFORNIA CITIES TO INTRODUCE LEGISLATION TO PROVIDE CITIES WITH AN EQUITABLE PRO RATA SHARE OF PROPERTY TAXES UPON ANNEXATION OF UNINCORPORATED TERRITORY. WHEREAS, Sections 98 and 99 of the Revenue and Taxation Code relate to the distribution of property tax revenues; and WHEREAS, said regulations provide that upon annexation of inincorporated territory to a city, the city receives no property :ax revenues unless the Board of Supervisors is willing to Joluntarily give up a portion of the county share; and WHEREAS, other taxing jurisdictions, primarily the schools, Ire not required to share a portion of their property tax revenues uith an annexing city; and WHEREAS, the present regulations create an inequity between Local taxing jurisdictions; and WHEREAS, the present regulations will cause cities to levy special annexation and service charges in order to compensate iities for the loss in property tax revenues; and WHEREAS, the present situation will create tax inequities between similar classes of property throughout the state; and WHEREAS, the present regulations in effect discourage annexations to cities and encourage no growth policies and uncoordinated planning and development programs; and WHEREAS, the present regulations require the City Council, Board of Supervisors, and property owners to negotiate each and every annexation, thereby wasting time and money on needless studies and arguments about the division of property taxes; and b # 1 2 3 4 F L E 'i E z 1( 1: 1: 1: 11 l! I( 1' 11 1' 2 2 2 2 2 2 2 2 2 WHEREAS, this problem was caused by the Legislature and can )est be resolved by the Legislature; NOW, THEREFORE, BE IT RESOLVED by the City Council of the :ity of Carlsbad, California, that: 1. The League of California Cities be and are hereby urged :o introduce legislation to amend Section 98 and 99 of the Revenue 2nd Taxation Code to require that upon annexation of unincorporated Zerritory to a city, the property tax revenues shall be reallocated in the same proportion as they are distributed in the annexing city 2. All taxing jurisdictions, including schools, be required to share an equitable portion of their property tax revenue 3ttributable to growth with the annexing city. 3. The City Clerk is hereby directed to distribute copies of the resolution to each city in San Diego County, each division Df the League of California Cities, the County of San Diego, and the State Legislature delegation. PASSED, APPROVED AND ADOPTED at a meeting of the City Council of the City of Carlsbad, California held the 5th of August I 1980, by the following vote, to wit: AYES: NOES: None Council Members Packard, Casler, Anear and Kulchin ABSENT : Counci 1 Member Lewis RONALD C.
