HomeMy WebLinkAbout1980-09-18; City Council; Resolution 63061 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 le 19 2c 21 22 22 24 25 26 27 2E RESOLUTION NO. 6306 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, URGING LEGISLATUE TO PROVIDE BY STATUTE THAT THE LOCAL HOUSING ELEMENT FULFILLS THE "DATE OF THE COASTAL ACT TO PROVIDE LOW AND MODERATE INCOkB HOUSING OPPORTUNITIES. FMEREAS, local jurisdictions are required by Government Code Section 65302 to adopt local housing elements in accordance with the State's housing element guidelines; and WHEREAS, the language of Section 30213 of the Coastal Act states that: "...housing opportunities for persons of low and moderate income shall be protected, encouraged, and, where feasible, provided. be developed in conformity with the standards, policies, and goals of local housing elements adopted in accordance with the requirements of subdivision (c) of Section 65302 of the Govern- ... " WHEREAS, it appears clearly the intent of the legislature that the local housing element should govern within the Coastal Zone as well as in the remainder of the City; and WHEREAS, the State Coastal Commission pursuant to Section 30213 of the Public Resources Code has chosen to impose different housing guidelines upon coastal lands than are required in the City housing element; and WHEREAS, the State Coastal Commission appears to be exceeding its authority in imposing guidelines which go beyond the local housing element; and WHEREAS, the locally elected legislative body is and by right should be responsible for adopting and implementing the -1- 4 I 2 r C 4 E . E 7 E s 1c 11 12 12 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 local housing element for the community as a whole; and WHEREAS, the current interpretation and policies of the Coastal Commission relative to housing are frustrating the basic goal of the Coastal Act to enact local coastal programs ; NOW, THEREFORE, BE IT RESOLVED that: Section 1. The State legislature be requested to amend Section 30213 of the Public Resource Code to clearly provide that the local housing element adopted pursuant to Section 65302 of the Government Code shall satisfy the housing policies of the Coastal Act. Section 2. The State Coastal Commission be requested to amend its guidelines to acknowledge that an adopted local housing element satisfies the housing policies of the Coastal Act.
