RESOLUTION NO. 6370
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
DRAINAGE AND SLOPE EASEMENTS AT HIGHWAY 78 AND JEFFERSON INTERCHANGE FROM THE STATE OF CALIFORNIA, DEPARTMENT OF TRANSPORTATION
CALIFORNIA, ACCEPTING RELINQUISHMENT OF A PORTION OF THE
WHEREAS, the State of California has served upon the City of Carlshad
the notice of intention of the Department of Transportation to relinquish
portion of the drainage and slope easement at the Highway 78 and Jefferson
Street interchange on the southerly side of that particular freeway referred
to as 11-SD-78; and
WHEREAS, the City Council has determined it is necessary and in the public
interest to accept such proposed relinquishment; and
WHEREAS, by the acceptance of this relinquishment there is vested in the
City of Carlsbad, all of the interest which the State of California might have
in right, title, in and to that portion of the State Highway hereinabove
described;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Carlsbad does, in behalf of the City of Carlsbad, agree to accept the slopes
and drainage easements at Highway 78 and Jefferson Street interchange on the
southerly side of that particular freeway 11-SD-78, more particularly described
in Exhibit A, which is attached hereto, and made a part hereof as if fully set
forth.
