RESOLUTION NO. 6392
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIJA, ACCEPTING BIDS, REJECTING ONE B1 D, AND AUTHOR-
IZING THq EXECUTION OF CONTRACT NO. 1071 FOR CONSTRUCTION
OF THE CQMMUNITY SWIM COMPLEX
WHEREAS, bilds have been received by the City of Carlsbad for the
~
construction of the Community Swim Complex, Contract No. 1071; and
WHEREAS, th~e City Council has determined that the public interest
requires the Counlcil to exercise its discretion under Section 3.28.120 of
the Carlsbad Municipal Code and reject the low bid submitted by K.D.H.
Corporation for nbn-conformance in bid proposal; and

WHEREAS, thk lowest responsive bid received for this project was
submitted by Devco Builders, lnc. in the amount of $947,398, including
the 80% solar system alternate with copper collectors; and
I
WHEREAS, funds are available for this project in Account Nos.

1-170-3030 and 22r170-3030,
NOW, THEREFPRE, BE IT RESOLVED by the City Council of the City of
I
Carlsbad as follows:

1. The abobe recitations are true and correct.
2. The bid/ of $947,398 for construction of the Community Swim
,
Complex, includin'g the 80% solar system alternate with copper collectors,
Contract 1071, is! hereby accepted and the Mayor and City Clerk are hereby
authorized to exebute a contract therefor.
