HomeMy WebLinkAbout1981-04-21; City Council; Resolution 64991 2 3 4 5 6 7 e 9 1c 11 12 12 14 1: 1E 17 1E 1s 2( 21 2: 21 24 2: 2( 2'; 2E RESOLUTION NO. 6499 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE, AND NECESSITY REQUIRE THE ISSUANCE OF A CERTIFICATE TO YELLOW CAB CO. OF SAN DIEGO TO OPERATE THREE TAXICABS IN THE CITY OF CARLSBAD AND ORDERING THE CITY CLERK TO ISSUE SAID CERTIFICATE SUBJECT TO CERTAIN CONDITIONS. WHEREAS, Western States Transportation, Inc., dba Yellow Cab Co. of San Diego, in accord with Chapter 5.20 of the Municipal Code has applied for a Certificate of Convenience and Necessity to operate taxicab service within the City of Carlsbad; and WHEREAS, pursuant to said chapter a public hearing was held on April 21, 1981, to determine whether or not the public interest, convenience, and necessity require the issuance of the certificate applied for and; WHEREAS, at said hearing all persons having interests in the matter were heard; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, as follows: 1. That the above recitations are true and correct. 2. That the public interest, convenience and necessity require the issuance of the certificate applied for. 3. That said certificate is hereby issued to Western States Transportation, Inc., dba Yellow Cab Co. of San Diego for a period of three years, subject to the following terms and conditions: //I/ I/// 1 2 3 4 5 6 7 8 9 10 I1 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 (a) The certificate permits service throughout the City of Carlsbad. (b) Three taxicab vehicles are authorized. (c) The schedule of fares to be charged shall be: Initial drop $ 1.20, including one-half mile; $.20 each additional 116 mile; $.20 each minute and one-half waiting time on traffic delay; $1.45 per mile on mileage driven five miles or more outside city limits. (d) The certificate and the operation of taxi service pursuant thereto shall be subject to all of the provisions of Chapter 5.20 of the Municipal Code. (e) The certificate is issued to commence on the date of adoption of this resolution and to expire on April 21, 1984. (f) Applicant's application form dated March 22, 1974, which is on file in the Office of the City Clerk, shall be made a part of this certificate, and is incorporated by re- ference herein. (g) The City shall have the right to inspect all vehicles at any time to insure they are maintained in safe operating condition. (h) Applicant may only use the vehicles listed on their application, dated March 22, 1974. (i) Applicant shall file certification of insurance in the amounts of $100,000/300,000 with the City Clerk prior to commencing service pursuant to this certificate. (j> No taxi stands are permitted. 4. That the City Clerk is hereby directed to issue a copy of this resolution as a certificate in accord with Chapter 5.20 of the Carlsbad Municipal code. 5.
