The City Council of the City of Carlsbad, California, does hereby resolve as follows: 1. That an amendment altering the weighted voting formula in the Joint Powers Agreement between the San Diego Association of Governments (SANDAG) and its member agencies, a copy of which is attached hereto marked Exhibit "A" and made a part hereof, is hereby approved. 2. That the Mayor of the City of Carlsbad is hereby authorize and directed to execute said agreement for and on behalf of the City of Carlsbad. Overall Wrk ProqrdBudget Review Process Upon initiation by the City of San Diego, the Board directed the Evaluation Camittee to analyze and make recamendations on the annual Overall Work Program (OWP) budget Process. Based on review of the history (Attamt C) and the current procedure and in the interest of mre periodic review of program and financial status and to enhance involvment by the Program Revia Camnittee (of Managers), it is the Evaluation Camnittee's that the cycle with reevaluation follawing additional process be carried out to take place in approximately one year: for the next a. That the Budget Camittee, as presently constituted, review the status of the mrk program and budget each Octaber and February and report to the Board; b, That the Program Review Cosrmittee, as presently constituted, attend the pro- gram status meetings held by the Budget Camnittee; and c. That the first regular Budget Canmittee meeting on the ccsning fiscal year Budget be a joint meeting of the Program Review Ccmnittee and the Budget carmittee r[ysnbers. 2. Weighted Voting Fomla The weightd vote of SANDAG was a concept conceived in 1971 to provide mre equitable voting balance to the Member Agencies on issues of extraordinary concern. as a "balanced" formula, so that no single agency or small group of members could daninate the Board. lation then accounted for about 52% of the regional total); the County 30 votes (population of the unincorporated areas was then about 25% of the region); and % remaining cities divided 30 votes proportional to their population. In 1980, with the County and Escondido no longer mgcs3ers, the formula was revised with each member agency receiving a proportional weighted vote accordhg to its population, with the proviso that no m&er muld get more than 40 votes. City of San Diego in 1980 represena approximately 46% of the regional population, but with the County and Escondido out, San Diego represented about 62% of the "mnber represented" population in SAND=. There is a legitimate issue regarding the need for the 5 Wrkr Agency requirement with the County a non-, since no 2 entities control a majority of the weighted vote. Presently it would take a mini" of 3 Menher Agencies to gain 51% of the vote since the next highestweighted vote after San Diego (40) is 9, As pointed out in the Evaluation Cannittee discussion, it is hypothetically possible for 4 agencies representing 66% of the weighted vote (San Diego, Chula Vista, Oceanside, El Cajon) to fail to carry a weighted vote for lack of a fifth concurring agency. The Evaluation Cdttee felt that amending the 5-agency requirement for the time that the County remains outside SANDAG should be discussed at this time before any particular issue of conflict arises which wuld likely necessitate a weighted vote. that this question be discussed first by the Executive Camnittee and then by the Board of Directors. The Executive Cdttee met on July 6 and recarmended the Board discuss changing the Formula to require only 4 concurring agencies rather than 5 to carry a weighted vote, with the proviso that when the County rejoins SANDAG, the Formula revert to 5 concurring agencies. The cumittee therefore recmended If the Board agrees with the above proposal to change the vote fonnula, it sbuld, by vote, authorize staff to forward Attacht B to the lktber Agencies for their action. Unanimous approval by Mepnber Agencies is required to amend the JPA. 3. Planning Consolidation Finally, the Evaluation Cdttee considered the recarmendations frm the Callahan Task Force which were referred to it by the Board. dealing with the consolidation of single purpose responsibilities under the general purpose areawide agency (SANDAG), it is the Evaluation Camittee's With respect to Policy 6 FE@%ENDATIm that "Consolidation of regional planning activities should be en- couraged and welmmsd in favor of 'cmprehensive' planning rather than 'single purpose' planning. 'I The Caranittee feels that such consolidation would be mre efficient and that asso- ciations of governments, such as SAMDAG, are appropriate vehicles to use for this purpose. W RICHARD J. The Board of Directors shall vo& on all itans on the basis of one vote per signatory Mmkr Agmcy, except if representatives of three signatory Menher Agencies request a weighted vote after voting on any particular itan, then in that event a new weighted vote which will be final and binding, shall be taken. B. When the weighted vote is taken there shall be a total of one hundred votes, except additional votes shall be all- pursuant to Section 19. following apprtionment formula, provided that each Member Agency shall have at least one vote, no Member Agency shall have mre than 40 votes, and there shall be no fractional vote: Each representative shall have that number of votes determined by the 1. Determine each Menber Agency's population. If any Mgnber Agmcy has 40 percent or mre of the total popu- lation of the San Diego County region, allocate 40 votes to that Mgnber &pry and follm step 2; if not, follow step 3. 2. Total the population of the rdng Mer Agencies determined in step 1 and ccmpute percentage of this total that each Member Agency has. a. b. C. d. e. 3. Multiply each prcentage derived above by 60 to determine fractional shares. Boost fractions that are less than one to one; add the whole nmbers. If the answer to step b. is 60, drop all fractions and the whole ncrmbers are the votes for each Mmhr Agency. If the answer to step b. is less than 60, the remaining vote(s) is allocated one each to that !&nber Agency(s) having the highest fraction(s) excepting those whose vote was increased to one (1) in step b. above. If the answer to step b. is more than 60, the excess vote (s) is taken one each frm the Member Agency (s) with the lowest fraction(s) . In no case may a vote be reduced to less than one.
