A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING RESOLUTION 5999 REVISING THE AMOUNT OF FEES TO BE REQUIRED AS A CONDITION OF APPROVAL FOR RESIDENTIAL DEVELOP- MENT WITHIN CERTAIN AREAS OF THE ENCINITAS UNION SCHOOL DISTRICT, WHEREAS, pursuant to Chapter 4.7, Division 1, Title 7 of the Ilifornia Government Code, the City Council of the City of Carls- Id, California has adopted a School Facilities Dedication and ?e Ordinance (Carlsbad Municipal Code Chapter 21.55): and WHEREAS, Section 21,55,150 of the Carlsbad Municipal Code rovides that the standards for the amount of fees to be required irsuant to such ordinance shall be determined by the City Council id set by resolution. Ide after consideration of recommendations from the qoverning oard of the affected school district; and The City Council*s determination is to be WHEREAS, the City Council established standards for the amount f fees to be required pursuant to Chapter 21.55 in Resolution 0. 5999; and WHEREAS, the City Council is in receipt of recommendations n regards to revised amount of fees from the Encinitas Union chool District, Their recommendation is attached hereto as xhibit A, and is made a part hereof; and WHEREAS, the City Council fully considered the matter at the egular meeting of August 18, 1981 at which the City Council etermined to concur in the revised standards as recommended by he Board of the Encinitas Union School District. // // // // 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 2% 2z 24 25 26 27 28 NOW', THEREFORE, BE IT RESOLVED by the City Council of the Iity of Carlsbad as follows; A. That the above recitations are true and correct. B. That the standard for the amount of fees to be required LS a condition of approval for residential developments within :hat portion of the City of Carlsbad, which is also within the )oundaries of the Encinitas Union School District, shall be as !ontained. in Exhibit A, C. This determination is based upon the City Council's ioncurrence in the recommendations made by the Governing Board of .he Encinitas Union School District, including the facts support- .ng such recommendations as contained in Exhibit A. D. Unless the decision-making body especially determines to .he contrary, the City Council hereby determines that the following 'indings and requirements shall apply to any residential develop- lent of 1. 2. 3. 4, 5. E, fifty units or less: All such developments shall be required to pay fees in accordance with the schedule in Exhibit A, The City Council has reviewed that portion of the General Pl.an which applies to the Encinitas Union School District and finds that it provides for the location of public schools. That the fees to be paid shall be used for the purpose of providing interim school facilities. That the fees to be paid for each unit bear a reasonable relationship to the burdens placed on the School District by such unit and that the fees will be used to mitigate that burden, That the school facilities to be funded by the fees are consistent with the City's General Plan. When the District is prepared to make their recommendation in that regard, the City Council intends to amend this resolution to include provisions for requiring the dedication of land as they determine to be in the public interests. F. Effective Date The fee schedule approved by this Resolution shall become effective on October 1, 1981. ($&so I ENCINITAS UNION SCHOOL DISTRICT Resolution No. 7-8182 RESOLUTION RE CONDITIONS OF OVERCROWDING IN SCHOOL ATTENDANCE AREAS On motion of Member Nortman , seconded by Member Madn tyrP the following resolution is adopted : WHEREAS, for some time past there has been a continuing and substantial increase in population within the boundaries of the Encinitas Union School District to the extent that the school facilities of this district have become overcrowded; and WHEREAS, in the absence of assistance in the form of financial contributions or dedications of land from the developers of such new residential developments this district would not have financial resources adequate to provide proper ed- ucational facilities for all the children residing in this district; and WHEREAS, Chapter 4.7 (commencing with Section 65970; added by Stats. 1977, Chap. 955), Division 1, Title 7 to the Government Code making provisions for financial or other assistance by developers to school districts if the governing board of a school district has made a finding that conditions of overcrowding exist in one or more attendance areas of the district including the specific data specified in Government Code Section ,65971; NOW THEREFORE IT IS RESOLVED AND DETERMINED that, pursuant to Government Code Section 65971, this governing board makes the following findings; (1) Conditions of overcrowding exist in the following attendance areas of the Encinitas Union School District which will impair the normal functioning of educational programs in those areas: Year-round/traditional schools: Capri, Flora Vista, Ocean Knoll, Park Dale Lane. Pacific View - year round at parental request Traditional school: Central School Agenda Item 3.15*(a) July 21, 1981 (2) Reasons for the conditions of overcrowding in the above-mentioned attendance areas include the following: a. developers. b. An influx of large single and multiple family dwellings by large Letters of availability issued to developers represent a potential 1740 students through 1990. Under policy 1-43 we are not meeting the adequate needs of the community according to the recent survey. (3) All reasonable methods of mitigating conditions of overcrowding have been evaluated and no feasible method for reducing such conditions exits. gation measures considered by the governing board of this district to reduce the overcrowded conditions include the following: Miti- a. Year-round school adopted in four of six schools for overcrowding as per District Policy 6159 requiring return to traditional track when facilities are available. b. Increased class size beyond Board practices from 27;l to 32:l teacher contract maximum. c. Passage of a lease/purchase bond was accomplished prior to Proposition 13. d. Portable classrooms through lease/purchase - we have added two additional units. e. District maintains open intra-district boundaries to equally distribute student population. (4) The conditions of overcrowding in this District and the explosive population growth projected for this area can only be accommodated by the new schools for the long-term; placement of temporary use buildings/relocatable structures and busing of students are stop-gap measures for the near-term only, and in and of themselves do not significantly reduce the conditions of overcrowding. Support by developers in the form of financial contributions or dedications of land is necessary in order to try to keep abreast of population growth, and even with such assistance, any significant reduction in the conditions of overcrowding will not occur until additional classroom buildings can be constructed. BE IT FURTHER RESOLVED AND ORDERED that the Secretary of this Board deliver certified copies of this resolution to the city councils and/or Board of Super- visors of all cities and County within those boundaries the school district lies, together with copies of this District's policy on the subject of developers', subdividers', and builders' contributions to mitigate impact on school facilities, to indicate the type and scale of assistance considered appropriate to meet the needs of this District. Resolution Setting Developers' Fees BACKGROUND: to submit: a fee schedule for collection of fees and a justification for the amount of the fees to all cities within the District boundaries. The County Board of Supervisors requires each school district RECOMMENDATION: The Superintendent recommends the following: RESOLUTION: Be it resolved that the Board of Trustees of the Encinitas Union School District does hereby continue the base fee of $426.00 per bedroom and apply the Engineering News Record Construction Index of 9.33%, therefore, setting the fees collected under 1-43 policy and S.B. 201 in the amount of $465.00 per bedroom from August 1, 1981 to July 31, 1982. In 1980-81 the ENR (Engineering News Record Index) was used $400 X 6.62% = $426.00 per bedroom For 1981-82 the ENR (Engineering News Record Index) is still being used $426 X 9.33% = $465.00 per bedroom. The Encinitas Union School District developer fees' will be $465.00 per bedroom beginning 8/1/81 to 7/31/82. This index is the same one being used by other districts in the San Dieguito area.
