HomeMy WebLinkAbout1981-09-01; City Council; Resolution 66621 2 3 4 5 6 7 8 9 10 11 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 6662 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING THE PROVISIONS OF RESOLUTION NO. 6226 AUTHORIZING THE ISSUANCE OF 1800 EDU'S OF SEWER CAPACITY ON A FIRST COME, FIRST SERVED BASIS, SUBJECT TO CERTAIN CONDITIONS. WHEREAS, on July 1, 1980 the City Council adopted Resolution No. 6226 authorizing the issuance of 1800 EDU's of sewer capacity on a first come, first served basis, subject to certain conditions within the Encina sewer territory; and 1 WHEREAS, THE City Council, at its meeting of July 24, 1981, received a comprehensive report from the City Engineer on the availability of sewer capacity within the City's service territories; and WHEREAS, based on the City Engineer's report, the Council indicated its intention to include the Palomar sewer service territory within the area subject to the allocation of 1800 EDU's of sewer capacity. The written report provided by the City Engineer which provided the basis for his testimony at the Council meeting is on file with the City Clerk and is incorporated by reference herein; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above-recitations are true and correct. 2. That the City Council is satisfied that the City has available sewer capacity because of the re-rating of the Encina plant which has been approved. 1 2 3 4 5 6 7 8 9 10 11 12 0 19 20 21 22 23 24 25 26 27 28 3. That the 1800 EDU's of sewer capacity, which is made available for use in the Encina sewer service territory by Paragraph 5 of Resolution No. 6226 shall also be made available for the Palomar Airport Drainage Basin, as shown on Exhibit A to Resolution No. 6226, subject to the same terms and conditions stated in said resolution. 4. That the provisions of Paragraph 9 of Resolution No. 6226 are repealed and that applicants subject to that paragraph shall be treated similarly to all other persons in the Palomar Airport Drainage Basin area. Applicants for sewer connection permits who have paid the connection fee of $2,000.00 according to the provisions of Resolution No. 6226 shall be refunded the difference between the $2,000.00 connection fee and the connection fee paid by all other persons in the Palomar Airport Drainage Basin area. 5. That the provisions of Paragraph 10 of Resolution No. 6226 are deleted. Projects in the redevelopment area shall comply with the Redevelopment Plan. 6. That except as otherwise provided by this resolution, all the provisions of Resolution No. 6226 shall remain in effect.
