RESOLUTION NO. (5671
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AUTHORIZING THE RETENTION
OF SPECIAL COUNSEL FOR SELF-INSURANCE DEFENSE.
WHEREAS, Section 2.14.130 of the Carlsbad Municipal
Code provides that the City Council may employ special counsel
under terms it considers proper; and
WHEREAS, the City Council has determined, upon
recommendation of the City Attorney, that it is necessary to
retain special counsel for personal injury defense; and
WHEREAS, the City has received proposals from the firms
of Higgs, Fletcher & Mack, dated June 24, 1981; Daley & Heft,
dated June 22, 1981; and Rhoades and Hollywood, dated June 19,
1981 to provide that representation, all on file in the office of
the City Attorney and incorporated by reference herein; and
WHEREAS, the City Council wishes to accept the proposals
from the three above-referenced firms and authorize the City
Attorney to assign cases to them as he considers appropriate;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the City Council hereby authorizes the City
Attorney to employ the law firms of Higgs, Fletcher h Mack;
Daley and Heft; and Rhoades and Hollywood for the City's self-
insurance defense in accordance with the terms and conditions of
the above-referenced proposals. The City Attorney is authorized
to assign cases to any of the law firms as he considers
appropriate.
3. That the City Council authorizes the expenditure
of funds from the liability self-insurance revolving fund
(Account 10-103-2870) as may be necessary to pay the fees of the
City’s special counsel.
PASSED, APPROVED AND ADOPTED at a regular meeting of
the City Council of the City of Carlsbad, California, on the
15th day of September , 19 81 , by the following
vote, to wit:
