RESOLUTION NO. 6694

A RESOLUTION OF THE C;TY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, SUPPORTING
THE EXTENSION OF THE BUENA VISTA LAGOON
WHEREAS, the City of Oceanside and the City of Carlsbad
have previously participated in the installation and maintenance
of a weir (water level control device) at the Buena Vista Lagoon;
and

WHEREAS, the engineer for the St. Malo Beach Association
has represented that an extension of the weir is necessary to
control flooding in the area and requested the cities of
Oceanside and Carlsbad to participate in the project; and
WHEREAS, the City of Oceanside, by the adoption of
Resolution No. 81-268 has endorsed and supported that project and
has assumed the responsibilities of lead agency therefor; and
WHEREAS, the City Council has determined it is in the
public interest to participate in the financing for the project;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad, California, as follows:
1. That the City of Carlsbad agrees to fund one half of the
cost of constructing a 30-foot extension to the Buena Vista
Lagoon weir in an amount up to,but not to exceed the sum of
$6,185. I
2. That the City's agreement to contribute toward the
funding of the project is conditioned upon the following:
A. That the City of Oceanside, California Department
of Fish and Game, concerned homeowners or others agree to fund
the balance of the project costs in excess of $6,185.
B. That the City of Olceanside, acting as lead agency,

will be responsible for accomplishing the project, including any
necessary environmental review, right-of-way acquisition,
permits, approval, and public bidding.
That the City of Carlsbad and its staff have not

independently evaluated the proposed project.
agreement to participate with the funding is based upon
representations by the City of Oceanside, the St. Malo Beach
Association and their engineer, Plr. A1 Ruden, that the proposed
project will further enhance and protect the Lagoon and adjoining
public and private property, and eliminate the flooding problem
which has occurred on Carlsbad city streets in the vicinity of
the Lagoon.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City
Council of the City of Carlsbad, California, on the 6th day
of October , 1981 by the following vote, to wit:
AYES: Council Members Packard, Casler and Anear
NOES: Council Members Lewis and Kulchin
