RESOLUTION NO. 6875
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A PRECISE
DEVELOPMENT PLAN (PDP-3A1, FOR EXPANSION OF THE
EXISTING SAN MARCOS MEADOWLARK WASTE WATER
TREATMENT PLANT ON PROPERTY GENERALLY LOCATED
APPROXIMATELY 800 FEET WEST OF RANCHO SANTA FE
ROAD, NORTH OF THE INTERSECTION OF QUESTHAVEN
ROAD AND RANCHO SANTA FE ROAD IN THE NORTH EAST
LA COSTA AREA.
APPLICANT: SAN MARCOS COUNTY WATER D1STRICT.PDP-SA
WHEREAS, on April 28, 1982 the Carlsbad City Planning
Commission adopted Resolution No. 1944 recommending that Precise
Development Plan (PDP-3A) be approved. Said resolution is
attached hereto as Exhibit A and is made a part hereof; and
WHEREAS, the City Council of the City of Carlsbad held a
public hearing on May 4, 1982 to consider the Planning
Commission's recommendations and to receive all recommendations
and hear all persons interested in or opposed to Precise
Development Plan (PDP-3A); and
WHEREAS, an Environmental Impact Report was prepared and
certified as complete in satisfaction of the requirements of the
City of Carlsbad Environmental Protection Ordinance of 1972 and
the California Environmental Quality Act for PDP-3 and the
Planning Director has determined that this project is in prior
compliance with said requirement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That the findings of the Planning Commission in
Resolution No. 1944 constitute the findings of the City Council
in this matter.

C. That Precise Development Plan (PDP-3A) for expansion of
the existing San Marcos Waste Water Treatment Plant is hereby
approved subject to all applicable requirements of the Carlsbad
Municipal Code and to the satisfaction of all of the conditions
of Planning Commission Resolution No. 1944 except as follows:
1. Condition No. 20 is revised to read as follows:
The District may distribute and dispose of reclaimed water
from the plant to property within the District that is also
within the City in accordance with the service agreement
between City and District approved by City on May 4, 1982.
2. Condition No. 21 is deleted.
D. This plan shall supersede any inconsistent portions of
PDP-3 as approved by Resolution No. 6080.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 18th day of May 9
1982 by the following vote to wit:

A RESOLUTION OF THE PLANNING COMMISSION OF' THE CITY
OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF
A PRECISE DEVELOPMENT PLAN FOR THE EXPANSION OF THE
MEADOWLARK RECLAMATION FACILITY ON PROPERTY GENERALLY
LOCATED ON THE WEST SIDE OF RANCHO SANTA FE ROAD IN
SAN MARCOS CANYON,

WHEREAS, said verified application constitutes a request as
xovided by Title 21 of the Carlsbad Municipal Code; and
WEEREAS, the Planning Commission did, on the 28th day of
ipril., 1982, hold a duly noticed public hearing as prescribed

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commis-
sion as follows:
(A) That the foregoing recitations are true and correct.
(B) That based on the evidence presented at the public hearing, the
Commission recommends APPROVAL of PDP-3(A), based on the
following findings and subject to the following conditions:
Findinss:
1) The proposed Precise Development Plan ensures compatibility OE
the development with the General Plan because:

fi) The General Plan Land Use Element designates a public
utility in this area.
b) Subsequent development in the area served by the treatment plant will be consistent with the General Plan because all zoning in the service area is consistent with
the General Plan.
) The proposed Precise Development Plan will no-t result in any
significant adverse impacts to the environment due to the
followinq reasons:
The conditions of approval include mitigation measures
outlined in the EIR certified by the San Marcos Counky Water District and mitigate potential adverse
environmental impacts,
The project will be subject to further review and
approval by effected State and Federal agencies, Said
review constitutes additional environmental imeact assessment, and insures the project s compatibility with
the natural manmade environment.
Adequate measures are required as part of the approval to
mitigate any adverse impacts the property may have.
The location of the project in a valley will reduce adverse impacts to surrounding property,

fauilities as necessitated by development and/or approvals in

The proposed wastewater treatment facility will serve as a complimentary use to the existing Encina Water
Treatment Plant by providing the area with additional
sewer capacity.
The proposed reclamation facility will reduce the amount
of potable water necessary to serve this area in the
future.
Said reclamation system could allow for the preservation and continuation of agricultural production.
All other public facilities will be available at time of
development,
The project is specifically exempted from the City's
Public Facility Fee Policy (City Council Policy No. 17).

Approval is granted for PDP-3(A), as shown on Exhibit(s)
''i.:" and "X" dated December 7, 1981 and "A" and ''F" dated
December 18, 1981, incorporated by reference and on file

the treatment plant, the applicant shall secure easement

final Precise Development Plan, The landscaping shall be designed to screen the treatment facilities from surrounding properties, Plans shall include fast growing, tall trees as
well as a combination of shrubs and groundcover, Plants shall be drought: tolerant, fire retardant where necessary, and
easily maintained,
Natural vegetation shall be retained wherever possible,
~ll pumps, generators and other noise producing mechanisms
shall be placed undergroung and/or shielded in such a manner to
reduce noise to a maximum of 55 dba at property line to all facilities.

streets are not adversely affected, The lighting plan shall
be subject to the approval of the Planning Director.

of six feet in height, with an addition of barbed wire

lines and the reclaimed water distribution lines and facilities shall comply with all the requirements of the
California Regional Water Quality Control Board, San Diego
Region Order No. 79-23, dated March 26, 1979 and any
addendurns thereto issued by the aforementioned Water Quality
Control Board.
12) The proposed i 1/2:1 slopes along the north, east and west
sides of the project site shall be flattened to 2:l or
otherwise brought into conformance with the provisions of the
city crf Carlsbad Grading Ordinance, The proposed 1 1/2:1
slope adjacent to the San Marcos Creek will be allowed as is
,s:) long as it is covered with a layer of rock slope protection
p!aced over a suitable filter blanket as shown on the proposed
<;xaling pl-ans for the project and as approved by the City
Erig ineer
13) LC~I additiun to the approval of the development indicated in
the exhibits noted above, all other requirements and appurtenances as listed in this approval shall be indicated on
the final Precise Development Plan,
14) If the fir?al design for the treatment plant is to include an
embankment along San Marcos Creek at the plant to guard
against flooding, then a 1601 permit from- California
Department of Fish and Game is to be obtained for the 23j/ alteration of the streambed.

15) Grading plans for all facilities shall be approved by the City Engineer, Such plan shall include provisions to limit
grading, cut and fill and excavation to the minimum areas necessary to prepare construction sites to reservoirs.
16) Surfaces shall be graded to direct runoff toward designed drainage facilities and away from any cut and fill slopes.

di:ciT season (April 16 to October 31), unless otherwise approved
by the City Engineer.
8) All graded slopes shall be stabilized for erosion control

copy which incorporates all requirements of the approval,

City Pianager shall determine that all applicable requireinents have been incorporated into the plan and that all conditions
of approval have been satisfactorily met or otherwise
guaranteed, The final signed Precise Development Plan shall
be the official site layout plan for the property and shall be
attached to any application for a building permit for any work undertaken, or structures or buildings constructed pursuant to this approval. No building permits shall be isseed until the
final Precise Development Plan is approved.
20) Prior to approval of the final Precise Development Plan, the
District shall enter into a service agreement with the city
of Carlsbad to permit the District to distribute and dispose
o€ reclaimed water from the treatment plant to property
within the incorporated limits of the city of Carlsbad.
21) ~rior to approval of the final Precise Development Plan, the
district shall enter into an agreement with the city yuaranteeiny that the district will make available to the city
t-:ac?,aimrd water from the treatment of sewage at the plant,
?he arnount of reclaimed water made available to the city shall
PL-~ no less equal to an amount proportionate to the amount of
i_.ekai;e produced in the city and treated at the plant.

available to the city,

22) A fire hydrant, supplied by a 6” main shall be installed at
the control building prior to occupancy,
